19. yüzyılda Tanzimat dönemi boyunca Osmanlı hükümeti taşrada pek çok müfettiş görevlendirmiştir. Müfettişlerin görevlendirilmesinin arka planında farklı sebepler vardır: Gülhane Hatt-ı Hümayunu’nun ilanının hemen akabinde, 1840 yılında, Ahmed Arif Hikmet Bey özellikle toprak rejimi hakkında bilgi toplamak ve halka Tanzimat sürecini anlatmak için Rumeli müfettişi olarak atanmıştır. Arif Hikmet Bey ayrıca halkın şikayetlerini de dinlemiştir. Bu teftişin amacı yerel düzlemde bilgi toplayarak tarımsal üretimi yeniden düzenlemektir. 1858 Kanunname-i Arazisi’nin yürürlüğe girmesinden sonra da teftişler benzer kaygılarla, bazen de dış müdahalenin önlenmesiyle amacıyla, devam etmiştir. Bu teftişlerden biri de 1860 yılında Sadrazam Kıbrıslı Mehmed Emin Paşa’nın Rumeli’de gerçekleştirdiği teftiştir. Bu araştırma sürecinde tutulan ve defter haline getirilmiş raporlar, 19. yüzyılın ikinci yarısında Bulgaristan ve Sırbistan’da toprak hukuku sorunları açısından önemli bir kaynak teşkil etmektedir. Ayrıca bu belgeler Osmanlı toplumunda yönetici sınıfıyla halk arasında ortaya çıkan cezai problemler hakkında önemli veri sunmaktadır. Bu makale Emin Paşa’nın teftişinde Niş ve Leskofça çiftliklerinde ortaya çıkan mülkiyet hukuku ve ceza hukukuna dair şikayetlerin ve çözüm sürecinin hukukî analizine dayanmaktadır.
Bu makale Hacettepe Üniversitesi Hukuk Fakültesi tarafından kabul edilmiş ulusal ve uluslararası araştırma ve yayın ilkelerine uygun bir biçimde yazılmıştır.Makale 16 Aralık 2019 tarihinde Nottingham Trent Üniversitesi Hukuk Fakültesi tarafından düzenlenen Flashpoints: Law, Religion and Human Rights adlı seminerde sunulan "The Administration by Intolerance in The 17th-Century Ottoman Empire: The Case of Consumption Ban" başlıklı tebliğin hazırlanması sırasında ortaya çıkan verilerin genişletilmiş hâlini içermektedir. Makalede öncelikle çeviriyazımı üçüncü kişiler tarafından çeşitli tez ve yayınlarla tamamlanmış arşiv kaynakları kullanılmıştır. Çalışmanın ileride Ayntâb şer'iye mahkemesine ait çeviriyazımı henüz yapılmamış kaynakları da incelemek suretiyle genişletilmesi düşünülmektedir.
