ABSTRAKPaper ini membahas tentang state of the art penyelesaian sengketa konstruksi di Indonesia yang meliputi jenis sengketa, indikasi potensi sengketa, dan perbandingan peraturan penyelesaian sengketa jasa konstruksi. Metode yang digunakan adalah mix method yang terdiri dari expert judgment, studi literatur dengan memperbandingkan riwayat penyelesaian perselisihan kontrak konstruksi mengacu kepada UU No.02/2017, Perpres No.16, UU No. 30 / 1999, dan PP No. 22/2020, dan Dispute Resolution Management Matrix (DRM-Matrix). Hasil analisis menunjukkan bahwa dua hal pokok penyelesaian sengketa yaitu pilihan penyelesaian sengketa dan penyelesaian sengketa di luar pengadilan (litigasi dan non litigasi). Penyempurnaan diberlakukan dalam PP No.22 Tahun 2020 yang menjelaskan tentang tahapan penyelesaian sengketa yang menyangkut mediasi, konsiliasi, dan arbitrase, juga terkait dengan penunjukkan dewan sengketa.Kata kunci: kontrak, konstruksi, perselisihan, state of the art ABSTRACTThis paper discusses of state of the art construction dispute resolution in Indonesia, which includes types of disputes, indications of potential disputes, and comparison of construction service dispute resolution regulations. The proposed method is a mixed-method consisting of expert judgment, literature study by comparing the history of construction contract dispute settlement referring to Law No. 02/2017, Presidential Decree No. 16, Law No. 30/1999, and PP. 22/2020, and the Dispute Resolution Management Matrix (DRM-Matrix). The results show that there are two main issues for dispute resolution, namely the choice of dispute resolution and dispute resolution outside the court (litigation and non-litigation). Improvements are enforced in Government Regulation No.22 of 2020 which explains the stages of dispute resolution involving mediation, conciliation and arbitration, as well as the appointment of a dispute board.Keywords: contract, constructions, dispute, state of the art
The millennial and generation Z tend to experience the negative impact of the decoy effect, so a consumer protection law is required. The purpose of this study is to demonstrate the negative impact of the decoy effect and the importance of consumer protection through digital literacy. A quantitative descriptive approach was used with millennial and generation Z research subjects who were given a choice of products using bait items. According to the study's findings, respondents are susceptible to the decoy effect, so consumers have the right to know before making a decision. The findings of this study contribute to the public's understanding and provision of suggestions or criticism, as well as to the government's formulation of consumer protection policies, particularly for the millennial and generation Z generations. The implication is that existing consumer protection laws must be flexible, rational, and based on digital literacy. Legal certainty as a form of consumer legal protection to achieve equality in an engagement as a concept for those who make transaction.
Enhancement of Sharia Arbitrators on Competence Quality in the Yogyakarta Special Region National Sharia Arbitration Board Abstract. The increase in cases resolved at the Yogyakarta Special Region National Sharia Arbitration Board (BASYARNAS DIY), the limitation of Islamic arbitrators, and the lack of expertise of arbitrators in dispute resolution raises issues related to the mastery of Sharia economic law for arbitrators in BASYARNAS DIY region. This community service program aims to increase the knowledge/ competence of expertise for Sharia arbiter in BASYARNAS DIY region, namely by conducting scientific discussions for Arbitrators as a basis for resolving Shariah economic disputes. The method of carrying out this dedication includes the preparation stage of scientific discussion, discussion on enhancing the competence of Sharia Arbitrators supported by pre-test and post-test during training and monitoring of evaluation activities as a reference for feedback for future discussion activities. This program was held on Friday July 26, 2019 in the meeting room of the Master of Law Degrees Program on the 2nd floor of the Postgraduate Building of Universitas Muhammadiyah Yogyakarta. The results of the community service activities were that the discussion went well and smoothly, attended by the BASYARNAS DIY Arbiter and internship students at the BASYARNAS DIY Region. With this discussion activity, the arbiter who previously did not understand about 50 percent related to the resolution of Islamic economic disputes to 100 percent really understood both materially and practically about the resolution of Islamic economic disputes delivered by speakers from the National Sharia Arbitration Board and the Indonesian National Arbitration Board so the arbiter's knowledge has increased significantly.Keywords: Enhancement, Competence, National Sharia Arbitration Board, Arbitrator.Abstrak. Meningkatnya perkara yang diselesaikan di BASYARNAS DIY, terbatasnya jumlah arbiter syari’ah, dan kurangnya keahlian arbiter dalam penyelesaian sengketa maka menimbulkan persoalan terkait penguasaan hukum ekonomi syari’ah bagi para arbiter di BASYARNAS wilayah DIY. Program pengabdian masyarakat ini bertujuan untuk meningkatkan pengetahuan/kompetensi keahlian bagi arbiter syari’ah di BASYARNAS wilayah DIY yaitu dengan cara melakukan diskusi ilmiah bagi Arbiter sebagai dasar dalam menyelesaikan sengketa ekonomi syari’ah. Metode pelaksanaan pengabdian ini meliputi tahap persiapan diskusi ilmiah, diskusi peningkatan kompetensi Arbiter Syari’ah yang didukung dengan pre-test dan post-test pada saat pelatihan dan monitoring evaluasi kegiatan sebagai acuan feedback untuk pelaksanaan kegiatan diskusi kedepannya. Kegiatan pengabdian ini dilaksanakan pada hari jumat tanggal 26 Juli 2019 di ruang sidang Magister Ilmu Hukum di lantai 2 Gedung Pasca Sarjana Universitas Muhammadiyah Yogyakarta. Hasil kegiatan pengabdian ini ialah kegiatan diskusi berjalan dengan baik dan lancar dengan dihadiri oleh Arbiter BASYARNAS DIY dan mahasiswa magang di BASYARNAS Wilayah DIY. Dengan adanya kegiatan diskusi ini maka para arbiter yang sebelumnya kurang memahami sekitar 50 persen terkait penyelesaian sengketa ekonomi syari’ah menjadi 100 persen sangat memahami baik secara materi maupun praktik mengenai penyelesaian sengketa ekonomi syari’ah yang disampaikan oleh narasumber dari Badan Arbitrase Syari’ah Nasional Pusat dan Badan Arbitrase Nasional Indonesia sehingga pengetahuan arbiter mengalami peningkatan secara signifikan.Kata Kunci: Peningkatan, Kompetensi, BASYARNAS, Arbiter.
Forest fire happened several times in Indonesia which impacting neighboring countries, such as Malaysia and Singapore. ASEAN tried to "heal" and prevent the possibility of similar events by signing the ASEAN Agreement on Transboundary Haze Pollution (AATHP) for its members. In line with that, this research examined the concern of the state responsibility principle and its dispute resolution as well as a mechanism under the Agreement in dealing with the transboundary haze pollution in ASEAN. The research conducted by using normative theory by using primary, secondary and tertiary legal materials, collected from library research. Data analysis uses statute approach and case approach. Furthermore, the resulting research is in the form of analytical descriptive. The researchers argue that AATHP it is not explained in detail about the forms, mechanisms, and consequences that can be given to a country that has caused forest fires in the national jurisdiction and proven damage other countries. The researchers conclude that there should be a clear definition of state responsibility by means of a visible dispute settlement. Those mentioned steps are aimed to prepare for both preventive and punitive legal action for all members of ASEAN in dealing with the case of transboundary haze pollution.
Indonesia is an archipelago consisting of 17,504 islands included in the territory. Indonesia needs transportation, especially sea transportation. Sea transportation needed to facilitate the transportation of people and goods, shipping safety. Therefore, the law which refers to the existence of improvement efforts for sea transport services, those passengers is entitled to compensation which shall be provided by the carrier due to negligence during the transport operation. The legal basis based on Law No. 17 of 2008 on shipping, consumer protection and security of shipping to have fulfillment the rights of victims on maritime transportation. The research will open the view on the settlement on liability of carrier against the loss of passengers. The purpose for bringing a change in the practice of marine transportation when accidents happen, getting the rights of accident victims, providing compensation for heirs, providing compensation for the property and provide accountability for victims. The method research used is the normative method. This's by recovering bibiliographic data and scientific journals as well as documents relating to the problems analyzed to implementation of legal protection for passenger safety. The result of the research is to involve in sea transportation must be careful in carrying out the transportation business.
