Não se questiona que a corrupção possui efeitos deletérios na regularidade da prestação de serviços públicos. Não se pode garantir, em um ambiente corrupto de contratação pública, que a empresa vencedora na concorrência pela obtenção do contrato público seja efetivamente a mais capaz, ou que aquele contrato atenda da maneira mais eficiente aos critérios discricionários de conveniência e oportunidade. A constatação da existência do fenômeno da corrupção, contudo, não é suficiente para dimensionar as consequências econômicas da prática. O presente artigo, por meio de análise qualitativa e quantitativa, propõe-se a: a) demonstrar a existência de ofensa à Ordem Econômica por meio da corrupção; b) analisar os efeitos microeconômicos da corrupção; c) analisar os efeitos macroeconômicos da corrupção Palavras-chave: Corrupção; Efeitos; Economia.
Esta pesquisa tem por objetivo analisar qual o modelo de responsabilidade penal da pessoa jurídica é mais compatível com o ordenamento jurídico brasileiro e com os princípios do Direito Penal moderno, através do método bibliográfico e jurisprudencial. Para tanto, far-se-á, primeiramente, uma breve análise da sociedade contemporânea do risco atrelada à proteção do meio ambiente e os impactos sociais na dogmática penal. Após, será examinada a responsabilidade penal da pessoa jurídica, através da previsão constitucional e legal, bem como do modelo teórico adotado. RESUMO O presente estudo objetiva analisar a relevância da intervenção do Direito Penal na proteção efetiva do meio ambiente, sob a óptica da “Sociedade de Risco”, conceituada pelo sociólogo alemão Ulrich Beck. Posto isto, destaca-se, inicialmente, as particularidades de cada sociedade, em dado momento histórico, descritas pelo autor, respectivamente: sociedade pré-industrial; modernidade clássica; e sociedade de risco. A primeira fase caracterizou-se pela convivência integrada entre homem e natureza, produção artesanal e perigos de danos naturais, justificados pelo misticismo e divindades. Após a ocorrência da “Dupla Revolução”, por efeito da Revolução Francesa (ideais iluministas) e da Revolução Industrial (transformação socioeconômica), surge a segunda sociedade, marcada pela prevalência da racionalidade antropocêntrica e científica, pela dissociação entre indivíduo e meio ambiente, divisão de classes e, sobretudo, pela industrialização em larga escala, mediante a união entre avanço tecnológico e exploração intensa do homem e de recursos ambientais, os quais eram necessários à lucratividade e à qualidade de vida.
