La responsabilidad solidaria se refiere a la unificación de múltiples materias, en el ámbito laboral respecto a las obligaciones que tienen las personas, al contraer un tipo de responsabilidad, objetos o prestaciones, los requisitos u obligaciones que tienen las partes y la existencia de relaciones internas entre acreedores o deudores. El objetivo principal del presente artículo científico, es analizar la figura de responsabilidad solidaria en materia laboral dentro de la legislación ecuatoriana y su aplicación en las relaciones empleador-trabajador. En la investigación se utilizaron los método exegético, análisis documental y revisión bibliográfica. Entre los principales hallazgos se tiene que, la figura de la responsabilidad solidaria brinda un eminente aporte en el ámbito laboral, garantizando los derechos de los trabajadores; con esta finalidad el Estado establece medidas precautelarías y sancionatorias para quién incurra u ocasione un perjuicio para la otra parte o el tercero involucrado.
En Ecuador, las mujeres han sido históricamente discriminadas en varios ámbitos, entre ellos, ha destacado negativamente, el laboral. En busca de mejoras para esa situación discriminatoria, la Constitución del Ecuador contempla significativos cambios en beneficio de la mujer embarazada y en período de lactancia, al punto que se consideran dentro del grupo de atención prioritaria. Esta investigación descriptiva con enfoque cualitativo hace referencia particularmente a los derechos laborales de las mujeres embarazadas y lactantes, con el objetivo de analizar la condición de vulnerabilidad de las mujeres embarazadas ante el despido intempestivo como hecho discriminatorio, identificando las normativas legales vigentes para aquellos casos en las que, por decisión unilateral del empleador, se dé por terminada la relación de trabajo. Se aplicaron los métodos: exegético, revisión bibliográfica y análisis de contenido; concluyendo que los derechos laborales de estas mujeres están garantizados en la Constitución y las leyes, de forma sólida; sin embargo, es necesario desarrollar con mayor amplitud la acción del despido ineficaz en el Código del Trabajo, a fin de cubrir los vacíos legales que presenta.
