Resumen: Tanto la eutanasia como el suicidio asistido no han sido temas suficientemente explorados por la doctrina chilena, falta de tratamiento que se agudiza al referirse a los menores de edad. El presente artículo tiene por objetivo dejar en evidencia que las principales disposiciones de derechos fundamentales relacionadas con la eutanasia y el suicidio asistido en menores de edad-el derecho a la vida y los derechos de los niños, niñas y adolescentes-admiten diversas interpretaciones y, en consecuencia, pueden ser utilizadas para argumentar a favor y en contra de la legalización de dichos fenómenos. Tras una breve definición de los conceptos a los que se hace alusión y un panorama general de la regulación comparada, se abordan los principales derechos involucrados, dejando en evidencia que los supuestos impedimentos jurídicos para la despenalización de la eutanasia y suicidio asistido son interpretaciones de los derechos involucrados, las cuales no resultan del todo concordantes con las actuales tendencias de la teoría de los derechos fundamentales y que, por ello, la sola variación en esta interpretación permitiría abrir la posibilidad de una regulación que, al menos, no sancione en todos los casos la eutanasia y/o el suicidio asistido de los menores de edad en Chile. Palabras clave: eutanasia; suicidio asistido; vida; menores de edad; derechos humanos Legal provision for the right of life of minors: a necessary discussion about euthanasia and assisted suicide in Chile Abstract: Both euthanasia and assisted suicide have not been sufficiently explored by Chilean experts, lack of reflection heightened when referring to minors. This article aims to make clear that the main provisions of fundamental rights related to euthanasia and assisted suicide in minors, that is the right to life and the rights of children and adolescents, admit diverse interpretations and, therefore, they may be used to argue in favor or against the legalization of such issues. After a brief definition of the concepts considered and a general view of compared legislation, the main rights involved are addressed, making clear that the supposed legal impediments to decriminalization of euthanasia and assisted suicide, are interpretations of rights involved, which they are not completely concordant with current tendencies about the theory of fundamental rights and, therefore, the only variation in interpretation will allow to open the possibility of a regulation that, at least, will not penalize all cases of euthanasia and assisted suicide of minors in Chile.
Actualmente, no se discute la vigencia o validez del principio/derecho a la igualdad o, más concretamente, a no ser discriminado. Los desacuerdos parecen centrarse en el alcance de la protección del mismo, especialmente entre privados, y, todavía más específicamente, en los límites de las acciones afirmativas. El panorama en Chile, por su parte, es bastante diferente, pues, si bien es posible afirmar que existen normas expresas e, incluso, instituciones propias del Derecho antidiscriminatorio, la carta fundamental no menciona la discriminación, razón por la cual la protección constitucional se ha llevado a cabo desde el derecho a la igualdad. Sostengo que la ausencia de cláusulas constitucionales de prohibición de discriminación, entendidas como un elemento que considera la pertenencia a ciertos grupos sociales, así como la conceptualización de la discriminación desde la arbitrariedad, generan la convivencia, de manera simultánea, de concepciones diferentes sobre la discriminación, hecho que aleja a Chile del tratamiento comparado habitual de la materia.
Este trabajo tiene por finalidad evidenciar la conveniencia de la utilización de investigación formativa como herramienta para aprender derechos fundamentales. Para ello se describe la manera más extendida de enseñar tales derechos, la cual consiste, preferentemente en la utilización de una metodología memorística. A continuación se examina la investigación formativa, indicando sus principales características y su adecuación al paradigma de la educación centrada en el/la estudiante. Con posterioridad se analizan los resultados de un estudio de percepción sobre la utilización de investigación formativa para aprender derechos fundamentales en estudiantes de Derecho de la Universidad de La Frontera. Para finalizar, a modo de conclusión, se realizan algunas reflexiones sobre las fortalezas y desafíos de esta estrategia metodológica.
El presente trabajo tiene por objeto mostrar que las tensiones más ostensibles entre la noción de ciudadanía diferenciada y la igualdad se superan mediante la adopción de la no subordinación como contenido de la igualdad. Para cumplir dicho objetivo se dedicará la primera sección al concepto de ciudadanía, distinguiendo entre ciudadanía universal y de la diferencia. Luego, en la segunda sección, se expondrán las distintas concepciones de la igualdad, mostrando las tensiones entre estas y la noción de ciudadanía diferenciada. En tercer lugar, se argumentará en favor de la compatibilidad entre la ciudadanía diferenciada y la igualdad como no subordinación. Se finalizará concluyendo que la igualdad como no subordinación es una nociónsuperadora de las distintas clases de igualdad abordadas, permitiendo superar los nudos críticos entre ciudadanía diferenciada e igualdad.
