Buku ini mengkaji aspek hukum Baitul Maal wat Tamwil (BMT) yang diawali dengan uraian mengenai BMT sebagai Lembaga Keuangan Mikro Syariah. BMT juga merupakan salah satu model sistem ekonomi kerakyatan yang perkembangannya dapat menopang percepatan pertumbuhan ekonomi nasional, namun secara yuridis, BMT didirikan dan dikembangkan dengan suatu proses legalitas hukum yang bertahap. Status BMT ditentukan oleh jumlah aset yang dimiliki, maka BMT memiliki status hukum yang berbeda pula sesuai dengan tahapan jumlah aset tersebut, serta tunduk pada hukum yang beragam dan parsial sesuai dengan tahap status hukum. Untuk itu, dalam buku ini, Penulis akan menguraikan konsep hukum pengaturan lembaga BMT di masa yang akan datang. Buku ini diharapakan memenuhi kebutuhan, baik akademisi maupun praktisi yang berminat mengkaji aspek hukum BMT, serta mahasiswa Fakultas Hukum, Fakultas Syariah, Fakultas Ekonomi, dan mahasiswa program Pascasarjana Bidang Kajian Utama Hukum Bisnis.
Pengetahuan tradisional yang merupakan milik masyarakat, diwariskan secara turun-temurun perlu dilindungi karena adanya potensi keuntungan ekonomis yang dihasilkan dari pemanfaatan pengetahuan tradisional oleh negara maju melalui biopiracy atau misappropriation. Rumusan permasalahan dalam artikel ini adalah mengenai bagaimana perlindungan hukum bagi masyarakat pemilik pengetahuan tradisional dari tindakan biopiracy atau misappropriation berdasarkan Undang-Undang Paten (UU Paten). Metode penelitian dalam penulisan merupakan penelitian normatif yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan undang-undang. Hasil dari penelitian ini adalah perlindungan hukum terhadap pengetahuan tradisional diatur dalam Pasal 26 UU Paten yaitu jika invensi berkaitan dengan dan/atau berasal dari sumber daya genetik dan/atau pengetahuan tradisional, harus disebutkan dengan jelas dan benar asal sumber daya genetik dan/atau pengetahuan tradisional tersebut dalam deskripsi, agar sumber daya genetik dan/atau pengetahuan tradisional tidak diakui oleh negara lain dan dalam rangka mendukung Access Benefit Sharing (ABS). Pembagian hasil dan/atau akses pemanfaatan sumber daya genetik dan/atau pengetahuan tradisional dilaksanakan sesuai dengan peraturan perundang-undangan dan perjanjian internasional di bidang sumber daya genetik dan pengetahuan tradisional.Kata kunci: Benefit Sharing; Paten; Pengetahuan Tradisional.
Baitul Maal wat Tamwil (BMT) was established and developed with a gradual process of legal legality, namely BMT in which its legal entity was not yet known, BMT that had not had a legal entity, and BMT that had a diverse legal entity. This writing aimed at analyzing the concept of legal strengthening of BMT in Indonesia. This type of legal research was normative legal research on legal principles and legal systematics. Based on the discussion, it was concluded that BMT could be a legal entity because it had fulfilled the requirements requested by legislation, namely the general rule of Article 1653 of the Civil Code which stated that in addition to genuine civil fellowship, the law also recognized assembly of people as legal entity, both held or recognized by the government, or the assembly was accepted as permitted, or had been established for a specific purpose that was not contrary to law or good morality. Juridical considerations for BMT institutions were legal legality for every sharia economic activity and the variety and partial legal norms of BMT.
