Perkembangan teknologi, informasi, dan komunikasi telah memberikan kontribusi yang besar bagi pemenuhan kebutuhan manusia, salah satunya di bidang perdagangan online atau yang lebih sering disebut dengan e-commerce. E-commerce memberikan banyak kelebihan bagi masyarakat, salah satunya adalah masyarakat dapat melakukan transaksi tanpa harus bertemu. Kompleksnya aktivitas dalam e-commerce tersebut tidak menutup kemungkinan bahwa e-commerce akan menimbulkan berbagai macam sengketa. Oleh sebab itu, diperlukanlah model penyelesaian sengketa yang cepat dan aman yang melindungi kepentingan para pihak.Penelitian ini termasuk penelitian normatif, dengan menggunakan pendekatan perundang-undangan dan pendekatan konsep. Untuk menyelesaikan sengketa e-commerce ini diperlukan suatu model penyelesaian sengketa yang cepat. Hal ini disebabkan apabila sengketa bisnis terlalu lama untuk dibiarkan maka akan menimbulkan menurunkan produktivitas serta menyebabkan terhambatnya kemajuan dan kesejahteraan ekonomi. Oleh sebab itu, gagasan untuk menggunakan sistem online dispute resolution (ODR) sebagai upaya penyelesaian sengketa yang cepat dan melindungi kepentingan para pihak yang bersengketa dalam transaksi e-commerce.
<p>Penelitian ini bertujuan untuk menganalisis keberadaan UU ITE dan Upaya Regulasi dalam menghadapi Serangan Siber. Saat ini, teknologi berkembang dengan begitu pesat,oleh karena itu, perlunya diadakannya perlindungan terhadap para pengguna IT saat ini agar para pengguna selalu merasa dilindungi oleh Hukum Indonesia. Penelitian ini menggunakan penelitian hukum normatif. Ditinjau dari sifatnya penelitian ini termasuk penelitian hukum yang bersifat deskriptif, Analisis terhadap rumusan masalah dilakukan secara preskriptif dengan menggunakan penafsiran Gramatikal dan penafsiran Sistematis. Pemberlakuan UU ITE merupakan hukum siber pertama di Indonesia yang bertujuan untuk memberikan kepastian hukum bagi masyarakat dan mencegah kejahatan yang ditimbulkan oleh teknologi informasi bagi penggunanya. Undang-undang khusus tentang kejahatan siber merupakan salah satu kebijakan kriminalisasi kejahatan siber yang ideal di Indonesia yang memuat aturan umum yang berlaku untuk semua kejahatan yang berlaku di bidang teknologi informasi dan komunikasi, kejahatan yang terkait dengan kerahasiaan data atau sistem di komputer. Penegakan hukum merupakan aspek penting dalam suatu negara. Dalam hal ini, POLRI sebagai penegak hukum yang memiliki fungsi, tugas dan wewenang untuk mewujudkan keamanan dan ketertiban masyarakat, termasuk mengambil tindakan tegas dalam penegakan hukum terhadap kejahatan siber.</p>
Introduction: Rail transportation is part of land transportation in Indonesia. The extended rail network has level crossings, namely the crossing of railroads and highways. Judging from the existing laws in Indonesia, the law mentions avoiding accidents at level crossings. Several factors influence law enforcement at railroad crossings, including legal, law enforcement, facilities, community, and cultural factors. There needs to be legal awareness from the side of law violators themselves, law enforcement officers themselves, and the government side. It is also necessary to increase cooperation between networks of law enforcement officers in crossing railroad crossings. Method: The research method used in this study is comparative descriptive. Result: The public is stated to have not understood the regulations that discuss railroad crossings listed in Law Number 23 of 2007, which discusses railways. In Law Number 22 of 2009, which discusses Traffic and Road Transportation, it is stated that Government Regulation 56 of 2009 discusses the Implementation of Railways and Government Regulation Number 72 of 2009 concerning Railway Traffic and Transportation. Conclusion: The law of crossing a railroad plot according to positive law in Indonesia has a position as a reference for travelling a railroad plot as has been written based on: Article 124 of Law Number 23 of 2007, Article 78 of Government Regulation Number 56 of 2009, Article 110 paragraph (1) Government Regulation Number 72 of 2009 & Article 114 of Law Number 22 of 2009.
This normative legal research with statutory and conceptual approaches aims to analyze the implications of train delays according to schedule in a progressive legal perspective and to construct ethical and legal responsibility for such delays. The results reveal that train delays not only harm passengers but also decrease public trust in rail services. In a progressive legal perspective, trust is the fundamental element for law to serve human interests. To address this issue, a minister of transportation regulation should be established to hold train service managers accountable for delays and provide ethical and legal obligations to passengers. By learning from the accountability of aircraft delays, such regulations can be adapted to rail transportation. Highlights: Train delays have negative consequences for passengers and public trust in rail services. Trust is a fundamental element for law to serve human interests. A minister of transportation regulation should be established to hold train service managers accountable for delays and provide ethical and legal obligations to passengers.
The Minister of Transportation of the Republic of Indonesia has issued Regulation of the Minister of Transportation Number PM 63 of 2019 concerning Minimum Service Standards for Transportation of People by Train which is a reference for infrastructure operators and / or operators of railway facilities in providing services to service users. Tidak terkecuali bagi PT. Kereta Api Indonesia (KAI) DAOP VI Yogyakarta which is the organizer of the Yogyakarta-Solo Electric Rail Train.This research is about the Implementation of the Regulation of the Minister of Transportation of the Republic of Indonesia Number 63 of 2019 concerning Minimum Service Standards for Transportation of People by Train, by taking place at PT. Indonesian Railway DAOP VI Yogyakarta. This research method is normative legal research, which uses key informants as research subjects, to analyze the development of information and its sources, then the sampling technique used is purposive sampling. The population in the study was all management and employees at PT. Kereta Api Indonesia DAOP VI Yogyakarta, while the sample used was only partly from the management and employees of PT. Indonesian Railway DAOP VI Yogyakarta dimulai dari arahan key informan. The results of the study are expected to inform that the implementation of the Ministerial Regulation has been implemented by the railway operator, namely PT. Kereta Api Indonesia DAOP VI Yogyakarta properly and correctly as stated in the provisions of the Regulation of the Minister of Transportation of the Republic of Indonesia Number 63 of 2019.
