RESUMOO presente ensaio, valendo-se da ‘Ética’2 e do ‘Tratado teológico-político’3 , ambos de Spinoza e, subsidiariamente, do ‘Tratado Político’4 e de seu ‘Epístolário’ (SPINOZA, 1966, p.108)5 , para mencionar as relevantes aos fins aqui propostos, tem como objeto refletir acerca da apropriação que Spinoza faz acerca da idéia de um ‘direito natural’, indagando, enquanto problema de pesquisa se sua abordagem é descritiva do que o direito é para contrapor, prescritivamente, como ele deveria ser. Nossa hipótese inclina-se pelo reconhecimento da relevância da atitude prescritiva na medida em que, descrevendo a vida ética Spinoza pretendeu no ‘TTP’ apresentar como deveria ser um estado laico. Trata-se, quanto ao método como se pode defluir do exposto, de uma pesquisa puramente bibliográfica.PALAVRAS-CHAVE: Spinoza; Ontologia; Ética; Teologia; Política; Descrição; Prescrição. ABSTRACTThis essay, drawing on the 'Ethics' and the 'Theological-Political Treaty', both by Spinoza and, in the alternative, the 'Political Treaty' and its 'Epistolary' (SPINOZA, 1966, p.108), to mention relevant to the purposes proposed here, has as its object to reflect on Spinoza's appropriation of the idea of a 'natural right', asking, as a research problem, whether his approach is descriptive of what the law is to counteract, prescriptively, as it is. should be. 1 O presente artigo, de caráter ensaístico, agora publicado em sua segunda parte, dividido que foi a pedido dos editores, é a parte final de uma pesquisa que começou há alguns anos e como desejo de ir mais fundo na reflexão sobre duas provocações: uma, entender as bases filosóficas da afirmação spinozana pelo qual 'toda determinação é negação' (incorretamente atribuída a Hegel) e, dois, pelo interesse que me despertou a pesquisa da colega que comigo coordena o núcleo de pesquisa 'Marxismo, realismo e direito', professora Lorena Freitas, sobre ideologia e os 'idola da tribo' de Bacon. Esses dois interesses nos levaram a uma participação na 'Jornada Bacon', em 2007, promovida pelo 'Grupo de Estudos Spinozanos da USP' e, alguns anos depois, a ela realizar um 'Seminário docente sobre Lógica', no âmbito de nosso Núcleo de Pesquisa, em 2015. Em outubro de 2018, a pesquisa foi retomada. Mas seu avanço e conclusão não seriam possíveis sem a concessão de uma licença-capacitação no início deste ano de 2019, pelo meu Departamento, na UFPB (pelo que agradeço a todos). Registro também o generoso apoio de nosso Núcleo de pesquisa na UFPB, sobre 'marxismo, realismo e direito', que do ano passado para cá me deu suporte para dar um fecho a todo levantamento feito nos anos anteriores. The present paper focuses on Amartia Sen and an aspect of his reflection on the Rawslian theory of justice, especially about the justification of substantive and social rights and more particularly those that demand the discussion about the character and nature of the right to private appropriation of social effort. Thus, tehe focuse is understand an aspect of Amartia Sen's reflection exposed in the 3rd chapter of 'Development as freedom', in which Sen contrast the formulation of Rawls' theory of justice, regarding the priority that the author grants the formal element of freedom to the detriment of its materialization and concretization. In the name of those emerges a clear theoretical (and practical) conflict with the demands for the realization of certain rights, resulting in a dichotomy between liberties (as formal, procedural or negative freedoms) vis-a-vis the liberal-individualist tradition and within which they are opposed freedoms (understood in the context of the debate put there as concrete, material or substantive freedoms). So, we have an antinomy will be confronted with the Hart’s 'Essays in Jurisprudence and philosophy', in the sense of pointing out that a problem with Rawls' formulation is that he does not understand it necessary to reconcile the admission of private property as freedom with the general principle of maximum ‘equal freedom’. So want to ask is whether the model proposed by Sen tackles this issue better and more adequately, which implies a hypothetical framework by which, by establishing a small number of basic freedoms, the Rawslian formulation does nothing more than treat property rights as mere formal guarantee of those who have it and to the detriment of all other components of the social body. It is, therefore, as to the method, of research centered on bibliographic review.
