L’article porte sur la question de l’absence de représentation des francophones hors Québec dans les débats sur les minorités en théorie politique. Les auteures affirment que la distinction entre minorités nationales et minorités ethniques ne permet pas de prendre en compte leur situation. Elles suggèrent que le concept de complétude institutionnelle proposé par Raymond Breton est plus approprié et en font l’équivalent du principe d’autodétermination pour les minorités nationales et de non-discrimination pour les minorités ethniques. Ainsi, elles confèrent au concept de complétude institutionnelle une dimension normative et montrent comment il permet de définir des mesures plus appropriées à la situation de minorités comme les francophones hors Québec que celles préconisées pour les minorités nationales et les minorités ethniques.
La externalización de fronteras de la Unión Europea ha impulsado en países terceros la creación simultánea de marcos de protección de derechos de personas migrantes, refugiadas y solicitantes de asilo con políticas de control, además de la transferencia de la detención y la deportación. Este proceso se observa en el desarrollo de las políticas migratorias en Marruecos donde, mientras la Ley 02-03 legaliza la deportación, la nueva Estrategia Nacional de Inmigración y Asilo establece un marco de protección. Así, este artículo examina el caso de Marruecos, en concreto, las prácticas de detención arbitraria en centros no formales, desplazamientos forzados y deportaciones de la población proveniente de África Occidental y Central entre 2019 y 2021, a partir de fuentes primarias y secundarias y en el contexto de la pandemia de la COVID-19.
La posición de la UE ante el conflicto del Sahara Occidental se ha caracterizado principalmente por: i) un posicionamiento mucho más tibio que en otros conflictos; ii) y por lo que se ha venido a denominar «la política del doble rasero», con una implicación distinta de las diferentes instituciones europeas, y con un posicionamiento desigual ante la negociación política de la salida al conflicto y la defensa de los derechos humanos. Se ha considerado que esta incoherencia se mantenía entre el posicionamiento político de las instituciones de la Unión, influidas por las presiones políticas de algunos de los actores implicados, como Francia y España; y por los intereses económicos de la UE, fundamentalmente relacionados con la explotación de los recursos naturales del territorio, mientras que parecía existir consenso sobre la apuesta clara de la UE por la defensa de los derechos humanos de la población saharaui. Sin embargo, este trabajo pretende demostrar que «el doble rasero» y la inconsistencia del posicionamiento de las instituciones europeas se ha trasladado incluso a la defensa de los derechos humanos. Así, mientras las instituciones europeas defienden los derechos civiles y políticos de la población saharaui en los Territorios Ocupados, además de denunciar la situación de precariedad que enfrenta la población de los campamentos de refugiados, ante la violación de los derechos económicos, sociales y culturales de la población saharaui los intereses económicos de varios Estados miembros de dichas instituciones se sobreponen a la defensa de los derechos humanos de pueblo saharaui. Este artículo tratará de demostrar esta incoherencia en la defensa de los derechos humanos de la población saharaui a través del examen de documentación tal como: informes de misiones de observación in situ, informes sobre la situación de los derechos humanos, apoyo a activistas saharauis, análisis de los flujos de ayuda humanitaria a los campamentos de Tinduf; así como del análisis jurídico de los distintos acuerdos firmados entre la UE y Marruecos para la explotación de los recursos naturales del territorio que pertenece a un pueblo que aún se encuentra en proceso de descolonización.
La vulnerabilidad de las personas lesbianas, gais, transexuales, bisexuales e intersexuales (LGTBI) durante su proceso migratorio ha generado una nueva preocupación en la comunidad internacional. En las últimas décadas se ha tenido en cuenta esta diversidad para generar mecanismos de protección, uno de ellos es la Red de Espacios Seguros (RSSN) en Centroamérica y México, bajo el ACNUR. Sin embargo, el camino para disminuir el grado de vulnerabilidad es complejo. El objetivo de este artículo es evidenciar las lagunas en la protección de las personas LGTBI en los espacios seguros en México y Guatemala. La metodología se apoya en la revisión de fuentes secundarias y en el trabajo de campo en el que se llevaron a cabo observaciones directas, grupos de discusión y entrevistas en profundidad a personas en tránsito, solicitantes de asilo y refugiadas LGTBI.
