Na aplicação de regras e normas jurídicas pelo Poder Judiciário brasileiro, atualmente é exigida uma atuação mais objetiva, inclusive mediante a utilização de métodos lógicos computacionais, interfaces artificiais e precedentes judiciais com aplicação obrigatória, o que, não respeitados determinados limites, pode levar à injustiça do caso concreto. Para a verificação dessa hipótese, o presente artigo busca refletir sobre a atuação do Poder Judiciário nacional frente à contemporânea sistematização do processo judicial e novas tecnologias, aplicando-se as regras e princípios constitucionais da dignidade da pessoa humana, legalidade, publicidade, eficiência, bem como a proporcionalidade e a razoabilidade, como normas processuais concretas e prevalentes, ainda que o conteúdo jurídico venha informado por conceitos indeterminados ou “conforme” o caminho histórico percorrido ou a percorrer. A pesquisa apresentada neste artigo se utiliza dos métodos descritivo, qualitativo, bibliográfico e dedutivo. Ao final, serão apresentadas as conclusões com ênfase nos principais aspectos encontrados ao longo da pesquisa.
Na construção de uma sociedade igual, justa e solidária, concretizada através da erradicação da pobreza e da efetivação da dignidade da pessoa humana, os três poderes da República deverão agir em parceria e harmonia, identificando quais as políticas públicas que devem ser cumpridas para que ocorra o desenvolvimento de toda a sociedade brasileira. A hipótese deste artigo é analisar se o Poder Judiciário, apesar do papel constitucional que lhe é específico, pode intervir na efetiva concretização das políticas públicas sociais destinadas à construção de uma sociedade justa e igualitária. Serão analisados conceitos sobre políticas públicas, a possibilidade do seu controle pelo Poder Judiciário e a concretização desse controle em decisões judiciais. Para a pesquisa, utilizou-se do método hipotético-dedutivo mediante uma abordagem crítica pela revisão bibliográfica, documental e jurisprudencial sobre a temática.
