Las enseñanzas históricas sobre los detonantes de la acción política demuestran que la movilización requiere apoyarse en potentes canales comunicativos de legitimación. No es un fenómeno de la contemporaneidad, sino una constante verificable desde las contiendas dialécticas del mundo clásico. En el caso español, la apertura de cauces para la participación que abrió la Modernidad alcanzó también al lenguaje político, con una semántica moralizada de la política que aunaba discurso virtuoso del gobierno y relato dinástico. Lo hizo tanto para la aculturación en la ideología regia como para la justificación de la resistencia a ella, desde la publicística y hasta la insurrección armada. Este artículo postula, desde una mirada interdisciplinar, la conveniencia de elevar al primer plano de análisis los componentes comunicativos del mensaje político que se asentaron con el surgimiento del Estado moderno; no sólo como precursores de la propaganda, sino como constituyentes discursivos de la llamada al cambio en distintos momentos históricos a lo largo del siglo XX. La cultura política española no podría comprenderse adecuadamente sin este elemento duradero que la Edad Moderna legó a la contemporánea para rescatar la política de la retórica y entregársela a la pragmática.
Cuando se cumple el V Centenario de las Comunidades de Castilla resaltan sus aspectos fundamentales, ligados no tanto a una sucesión de acontecimientos políticos intensos, menos aún a unos enfrentamientos bélicos, como a los principios de participación del común en las cosas de la gobernación. Comunidad, participación política, ciudadanía, cambio institucional y resistencia son notas que jalonan el paso de la dimensión jurídica a la política en la revuelta comunera. Son simultáneamente términos y conceptos de gran modernidad que calaron profundamente en el imaginario colectivo y han marcado una dinámica parlamentaria decimonónica que pasó al siglo XX con ribetes de gran actualidad hoy. La tratadística política del momento y, sobre todo, las demandas ciudadanas en las Cortes y en los capítulos comuneros son expresión de los anhelos de implicación de un pueblo activo en el gobierno. Frente al ideal imperial de Carlos V se alzó la tradición política hispánica sobre la base de la solidaridad ciudadana. La ratio iuris fue así acompañada de ideas políticas, aspiraciones sociales, problemas económicos y un profundo sentido moralizado de la acción política en términos que interesan al parlamentarismo contemporáneo por su atemporalidad.
Esta forma de Estado hunde sus raíces en la tradición de pensamiento político grecorromano. Solón realizó una reforma política e instauró una constitución política en la que los diferentes estamentos sociales estaban representados y todos pudieran participar en el gobierno de Atenas.
Una sociedad hiperconectada como la actual española debe hacer frente al incremento de riesgos y amenazas que se ciernen sobre la seguridad pública y la seguridad nacional en el paso del mundo físico al lógico. El ciberespacio ha pasado a interesar al Derecho en distintas ramas. La ciberseguridad, en consecuencia, ha sido regulada parcialmente por normas administrativas y penales, pero algunas implicaciones constitucionales resultan de extraordinaria importancia, como ha puesto de relieve el conjunto de medidas adoptadas por la pandemia, deviniendo insuficiente la previsión de planes y normas anteriores. Una mirada crítica a la normativa vigente arroja resultados altamente insatisfactorios, por lo que sería deseable que el ordenamiento plantease a corto plazo mayor capacidad de protección de los ciudadanos y de resistencia a los ciberataques, con escrupuloso respeto a los derechos fundamentales. Se propone aquí una metodología multidisciplinar de análisis de situación y un conjunto de propuestas legislativas que afectan a varios campos, y de ahí la necesidad de interdisciplinariedad jurídica, no exenta de una mirada politológica.
