O objeto do presente artigo concerne ao exame do conceito de senso comum teórico dos juristas e à investigação a respeito de suas funções sob a égide da Teoria Crítica do Direito desenvolvida por Luís Alberto Warat. Estrutura-se, assim, em duas etapas: a primeira, de caráter semântico, adstrita à conceituação e significação do objeto de pesquisa; e a segunda, de jaez teleológico-funcional, atinente à identificação de regiões e de suas funções ou efeitos.
Hans Kelsen nasceu na cidade de Praga, em 1881, e é hoje cultuado em toda a parte como um dos mais influentes juristas de sempre. Apesar do impacto de sua obra, sua doutrina sobre a ciência do direito tem sido alvo de severas refutações. Muitos de seus intérpretes entendem que essas críticas são desprovidas de congruência. Sem embargo, há refutações que devem ser levadas a sérios, por derivarem de teses consistentes. O objeto do presente artigo concerne ao exame do plexo de críticas dirigidas ao pensamento de Hans Kelsen – especificamente à sua Teoria Pura do Direito –, temática que logra relevância por referir-se ao autor cujo positivismo estabeleceu um paradigma que deixou marcas ainda vivas no modo de compreender o direito. Este artigo está organizado em três partes: a primeira, de cariz introdutório, apresenta a teoria pura do direito como uma teoria tipicamente positivista; a segunda parte, dedicada ao desenvolvimento do tema central, aborda as principais objeções à teoria pura do direito; a terceira seção, de perfil conclusivo, reúne as considerações finais.
