ZusammenfassungDie Behandlung von Patienten bedarf der Einwilligung. Diese ist nur rechtskräftig, wenn der Patient einwilligungsfähig und über die für ihn wesentlichen Umstände informiert ist. Die Zahl der nicht einwilligungsfähigen Patienten nimmt aufgrund der demografischen Entwicklung und der Fortschritte der Medizin zu. Nach wie vor setzen sich viele Menschen nicht mit ihren mögli-chen Vorstellungen, Wünschen und Erwartungen bezüglich der gewünschten menschlichen und medizinischen Betreuung und Versorgung am Lebensende und/oder bei lebensbedrohlichen Erkrankungen auseinander. Eine Patientenverfügung und/oder Vorsorgevollmacht stellt eine Möglichkeit dar, den eigenen Willen für den Fall zu bekunden, in dem eine eigene Willensäuße-rung nicht möglich ist. Diese bezieht sich in den allermeisten Fällen auf das Lebensende. Für den behandelnden Arzt besteht trotzdem das Problem, den mutmaßlichen Willen des Patienten genau eruieren zu müssen, um die Autonomie des Betroffenen auch in dieser Situation wahren zu können. It is legally effective only if the patient is capable of giving his consent and can be informed accordingly. Due to the demographic development and the progress in medicine the number of patients who are not able to give their consent is increasing. Most people, however, still do not think about their probable priorities, wishes and expectations concerning the human and medical attendance at the end of their life or in case of a life-threatening illness. A living will and power of attorney for healthcare are opportunities to express one's own will in writing, in case verbal communication is impossible. This measure of precaution is mostly related to end-of-life matters. For the treating physician, however, the task to protect the individual's autonomy by assessing the probable wish of the patient will remain difficult.
