La protection de la jeunesse est inscrite à l’agenda politique depuis les réformes institutionnelles des années 1980. Si, de leur côté, les communautés ont réformé ce qui relève de leur compétence, à savoir l’aide et l’assistance à la jeunesse, la matière qui relève de l’État fédéral, à savoir les mesures à l’égard des mineurs ayant commis un fait qualifié infraction, a été réformée par la loi du 4 mai 2006 impulsée par la ministre de la Justice L. Onkelinx (PS). La nouvelle législation s’inscrit dans le contexte de la montée en force des droits des jeunes. Par ailleurs, au-delà des débats théoriques sur la justice des mineurs (justice pénale, protectionnelle ou restauratrice), on assiste à l’émergence de pratiques restauratrices comme les médiations et le travail d’intérêt général. Parallèlement, l’espace médiatique est envahi par le thème de l’insécurité, souvent relié à la délinquance des jeunes, ce qui presse les responsables politiques à formuler des réponses plus fermes. Enfin, les sensibilités communautaires sont parfois fort contrastées quant aux solutions à apporter à la délinquance juvénile. Les auteurs rappellent les étapes antérieures de la réforme jusqu’à la présente législature. La philosophie protectionnelle semble rester la réponse à la délinquance juvénile en Belgique, alors que dans les divers pays occidentaux, on assiste depuis 30 ans à un retour de la logique sanctionnelle voire pénale dans la prise en charge des mineurs délinquants. Les auteurs expliquent dans le détail le travail politique et législatif qui a conduit à l’adoption de la nouvelle législation fédérale. Ils présentent les nouvelles mesures et les nouvelles procédures. Un chapitre est consacré aux points de tensions et de compromis qui ont jalonné deux ans de débats. Enfin, ils examinent les premières décisions de mise en œuvre de la nouvelle loi, adoptées dans la foulée de l’affaire Joe Van Holsbeeck.

Résumé Des débats entamés dès le début des années 1990 visaient un changement en profondeur de la justice des mineurs. L’idée d’un droit sanctionnel éducatif émergeait. Aujourd’hui, le projet de loi déposé par la ministre de la Justice L. Onkelinx (PS) tente de maintenir la tradition belge d’un droit protectionnel pour les mineurs. La réforme en cours semble tourner le dos aux pistes étudiées durant plus de dix ans : il s’agit d’une adaptation de l’approche protectionnelle plutôt qu’une révolution, ce qui nécessite de retracer les événements qui ont conduit à ce résultat. L’étude débute par les effets de l’abrogation de l’article 53, qui empêche de maintenir l’enfermement des mineurs et ranime les volontés de réforme. Elle aborde ensuite les développements de la justice restauratrice, et en particulier les conceptions et les expériences déployées en Flandre. Les mesures apparentées à ce modèle sont conseillées par nombre de spécialistes. Elles se présentent comme une troisième voie pour sortir de la tension entre « punir » et « éduquer », dilemme dans lequel s’enlisait le processus de réforme de la loi protectionnelle. L’étude se termine par l’analyse du processus politique qui a conduit à la création du centre fermé d’Everberg. Alors que les discussions sur un vaste projet de justice sanctionnelle élaboré par le ministre Marc Verwilghen s’enlisaient sous la législature précédente, l’agenda politique a été bousculé par l’abrogation de l’article 53 qui permettait l’incarcération de mineurs. Les différends politiques au sein de l’arc-en-ciel mais aussi la volonté d’engranger des mesures pouvant rassurer l’opinion ont conduit à la création, décidée dans la hâte, du centre fermé d’Everberg, mis en service en mars 2002. Rédigée conjointement par des chercheurs du Nord et du Sud du pays, l’étude met en valeur les différences d’argumentaires et de sensibilités qui existent entre les deux grandes communautés.
