Exemption from testifying and the right to refuse to testify in Roman criminal procedureThe author of article examines the scope of the exemption from testifying for the prosecution and the right to refuse to testify in the Roman criminal procedure before quaestiones. She focuses mainly of Callistratus’ and Ulpian’s accounts of lex Iulia de vi and Paulus’ account of lex Iulia iudiciorum publicorum. This is because there are doubts, especially with regard to the nature of rights or exemptions applying to testimonies concerning relations based on close kinship parents-children or patronage as well as marriage. Das Recht der Aussageverweigerung oder die Freistellung von Aussagen im römischen StrafprozessIn diesem Aufsatz wurde der Umfang der Gültigkeit der Disqualifikation als Zeuge der Anklage aufzutreten sowie das Recht der Aussageverweigerung im römischen Strafprozess vor den quaestiones behandelt. Die Analyse konzentriert sich hauptsächlich auf Überlieferungen von Callistratus und Ulpianus betreffend die Regelungen von lex Iulia de vi sowie von Paulus betreffend lex Iulia iudiciorum publicorum. Vor diesem Hintergrund entstehen nämlich Zweifel besonders hinsichtlich des Charakters der Berechtigungen oder der Freistellungen im Bereich der gegenseitigen Aussagen im Zusammenhang mit der Relation, die auf naher Verwandtschaft Eltern – Kinder oder dem Patronat, wie auch der Ehe beruhte.
Celem niniejszego artykułu jest przeanalizowanie możliwego wpływu prawdziwości twierdzenia na przyjęcie odpowiedzialności z tytułu deliktu iniuria. Zakres studiów ograniczony jest do regulacji pretorskich odnoszących się do adversus bonos mores convicium facere, tak zwanego edyktu de adtemptata pudicitia i ne quid infamandi causa fat z pewnymi uwagami na temat koncepcji iniuria-contumelia.
The article concerns the matter of domum vi introire – a violent intrusion into someone’s house, introduced into Roman Law by Cornelian law de iniuriis in 81 BC. The issue is analysed in the socio-political context of introduction of this regulation aimed to define its ratio legis as strictly connected to the goal of providing peace and safety in the city, and, by this means, establishing the new order. However, the conduct of domum vi introire was considered as closely related to the dignity of an individual from the very beginning, and as such complying with the concept of iniuria created within the praetorian edicts. It is exactly this feature that enabled the evolution of perception of this conduct in the direction of the contemporary concept of trespass.
The origin and credibility of a witness in the Roman criminal procedure in the light of selected speeches by CiceroThe article is devoted to an analysis of the significance of a witness’ origin to his credibility in the Roman criminal procedure on the basis of selected speeches by Cicero — Pro Fonteio, Pro Scauro and Pro Flacco. The extensive use of arguments relating to the nationality of witnesses testifying against the orator’s clients suggests that such references may have been important in the assessment of the credibility of their testimony, despite the fact that formally Roman law did not introduce any restrictions on testifying based on the witness’ origin. Drawing on her analysis of the selected speeches, the author concludes that the references to a witness’ origin and characteristics attributed to a given nation replace arguments relating to the witness himself, without being of crucial significance on their own and being only a necessity in a situation where there is no information about the witness. Herkunft und Glaubwürdigkeit eines Zeugen in römischen Strafprozessen im Lichte ausgewählter Reden CicerosDer Aufsatz ist der Analyse der Bedeutung der Herkunft eines Zeugen für die Bewertung seiner Glaubwürdigkeit im römischen Strafverfahren auf Basis von ausgewählten Reden Ciceros — Pro Fonteio, Pro Scauro und Pro Flacco gewidmet. Die breite Verwendung von Argumenten betreffend die Nationalität der Zeugen, die mit ihren Aussagen die Klienten des Orators belasteten, könnte die wesentliche Bedeutung dieser Bezugnahme auf die Beurteilung der Glaubwürdigkeit von Aussagen andeuten, obwohl das römische Recht formal keine Einschränkungen im Bereich von Aussagen im Hinblick auf die Abstammung einführte. Die Analyse der genannten Reden führt die Autorin zum Schluss, dass die Bezugnahme auf die Abstammung und die Zurechnung charakteristischer Züge einer Nation, eine Ersatzfunktion im Hinblick auf die Argumente betreffend den Zeugen selbst darstellten, allein keine wesentliche Bedeutung hatten und in der Situation notwendig waren, wenn Informationen über den Aussagenden fehlten.
