RESUMEN.Este ensayo propone una crítica a la tesis pragmática según la cual los enunciados probatorios de las decisiones judiciales del tipo «está probado que p» poseen fuerza descriptiva siendo, por tanto, verdaderos o falsos. En primer lugar, se dilucida la noción de fuerza pragmática y se estipula la distinción entre enunciados descriptivos y normativos. Luego, se muestra que en los contextos procedimentales donde el sistema de valoración de la prueba es el conocido como Sana Crítica Racional, los enunciados probatorios, por una parte, expresan un juicio valorativo de quien los profiere y, por la otra, fungen de razones prácticas dirigidas a justificar una acción del mismo emisor, a saber: la aceptación del enunciado fáctico como premisa de la decisión judicial. Estas circunstancias, se sostiene, muestran que enunciados probatorios proferidos en esos contextos poseen fuerza normativa postulándose provisoriamente su carácter constitutivo.Palabras clave: enunciado probatorio, estándares de prueba, sistemas de valoración, fuerza pragmática. About the strength of Proof statements in Judicial Decision: the constitutive LeapAbstRAct. This essay proposes a criticism to the pragmatic thesis according to which, the proof statements of judicial decision of the kind «it is proven that p» have descriptive strength, being, therefore, true or false. First of all, the notion of pragmatic strength is enlightened and the distinction between descriptive statements and normative statements is provided. Then, it is shown that in judicial process contexts where the proof evaluation system is the well-known as principle of «free proof», the proof statements, in one hand express a judgment of value of the one that utters them, and in the other hand, they work as practical reasons aiming to justify an action of the decision-maker by himself, namely: the acceptation of the factual statement as a premise of the judicial decision. This circumstances, it is upheld, demonstrate that proof statements issued in this kind of contexts bear a normative strength, postulating temporarily their constitutive character. El artículo apunta contra la concepción objetivista de los estándares de prueba defendida en la obra conjunta de Jordi Ferrer Beltrán. Se toma en consideración, como blanco principal de la crítica, su último trabajo: Prueba sin convicción. En primer lugar, se pone de manifiesto por qué el autor está comprometido con una visión objetivizada de los estándares de prueba y en qué sentido ha de entenderse ese objetivismo. Luego, se desarrollan varios argumentos para mostrar que esa visión está desencaminada. Algunos de esos argumentos apuntan contra réplicas que Ferrer Beltrán articula en Prueba sin convicción frente a objeciones más antiguas. Por último, luego de mostrar por qué la pretensión objetivista tiene que ser abandonada, se propone una relectura de las fórmulas que establecen supuestos estándares de prueba.

Para ello, se reconstruye en primer término la concepción doctrinaria mayoritaria de la prisión preventiva que algunos denominan "concepción cautelar". Se muestra luego que las premisas normativas en que los jueces basan sus decisiones responden a esa concepción doctrinaria, lo que se verifica en una pluralidad de ordenamientos jurídico-procesales que en muchos otros aspectos son muy divergentes. Se presentan luego algunas críticas, en general también provenientes de la doctrina, que alegan la ilegitimidad de la prisión preventiva así concebida.
Este trabajo pone de manifiesto un bucle de inconsistencias entre tres aristas argumentales que Larry Laudan defiende a lo largo de sus reflexiones sobre la prueba en el contexto del proceso judicial. Por una parte, se reconstruyen los argumentos que Laudan aduce para mostrar que la fórmula más allá de toda duda razonable no constituye siquiera mínimamente un estándar genuino de prueba. Por la otra parte, se reconstruyen algunos de sus argumentos dirigidos a mostrar que esa fórmula produce una excesiva cantidad de falsos negativos. En tercer lugar, se pone de manifiesto su propuesta a efectos de sortear estos problemas. Se explicitará una inconsistencia entre las primeras dos aristas argumentales que Laudan desarrolla y se mostrará, además, que su propuesta se torna ilusoria, en gran medida, en virtud de sus propios argumentos en contra del más allá de toda duda razonable. Se sugerirá que la solución de estos problemas debe buscarse por otro camino.
