Abstrak: This paper aims to examine the potential problems of Complete Systematic Land Registration (PTSL) as the government's priority agenda to establish land registration throughout Indonesia. This study uses a normative legal research approach by analyzing the legislation related to land registration, especially PP. 24 of 1997 concerning Land Registration and Ministerial Regulation ATR/Ka. BPN No. 12 of 2017 as amended by Ministerial Regulation No. 6 of 2018. The potential of this problem relates to the issue of tax and income tax payable, human resources, facilities and infrastructure, issues absentee land, maximum excess of land ownership, abandoned land, announcement of physical and juridical data, and problems of application of the principles of contradictoire delimitation. The potential of this problem is described and is given alternative solutions on the implementation of PTSL. Alternative solution is by strengthening the regulation of PTSL in the form of Government Parliament (PP), either by revising PP. 24 of 1997 and by forming a separate PP on PTSL by clarifying the outlined problems.Intisari: Tulisan ini bertujuan untuk mengkaji potensi permasalahan pendaftaran sistematik lengkap (PTSL) sebagai agenda prioritas pemerintah untuk menyelengarakan pendaftaran tanah seluruh Indonesia. Kajian ini mengunakan pendekatan penelitian hukum normatif dengan cara menganalisis peraturan perundangundangan yang berkaitan dengan pendaftaran tanah, khususnya PP No. 24 Tahun 1997 tentang Pendaftaran Tanah dan Peraturan Menteri ATR/Ka. BPN No. 12 Tahun 2017 sebagaimana diubah dengan Permen No. 6 Tahun 2018. Potensi permasalahan ini berkaitan dengan masalah biaya Pajak PPh dan BPHTB terhutang, sumberdaya manusia, sarana dan prasarana, permasalahan tanah absentee, kelebihan maksimum dan tanah terlantar, masalah pengumuman data fisik dan data yuridis, serta masalah penerapan asas kontradiktur delimitasi. Potensi masalah ini di diskripsikan dan diberikan aternatif solusi dalam pelaksanaan percepatan PTSL. Aternatif solusinya adalah dengan cara memperkuat regulasi PTSL dalam bentuk Paraturan Pemerintah (PP) baik dengan cara merevisi PP No. 24 Tahun 1997 maupun dengan membentuk PP tersendiri mengenai PTSL yang pada pokoknya pengaturan isi-nya salah satunya memperjelas permasalahan-permasalahan yang diuraikan diatas.
The quality of land data is a very important part to prepare for the implementation of electronic land certificates, so the purpose of this study is to analyze the quality of land data, especially at the Semarang Regency Land Office. This study uses a qualitative descriptive method to see the precision of spatial data so that the data can be categorized as valid data. The results showed that the criteria for valid land parcel data were fulfilling the aspects of the correctness of the location, shape, area and numbering standards, but there were still land parcels with valid status in the Computerized Land Activities (KKP) application that did not meet the criteria set out in the Technical Guidelines. Thus, it will affect the implementation of electronic land certificates, because between the quality of data and the implementation of electronic land certificates is a unity, good land data will produce quality electronic land certificates that can provide a sense of security and legal certainty and are not easily sued, because the resulting land data from transfer of media as electronic documents. Keywords : Land Data Quality, Electronic Land Certificate, Spatial Data INTISARI Kualitas data pertanahan merupakan bagian yang sangat penting untuk mempersiapkan pelaksanaan sertifikat tanah elektronik, maka tujuan penelitian ini adalah hendak menganalisis kualitas data pertanahan, khususnya di Kantor Pertanahan kabupaten Semarang. Penelitian ini menggunakan metode deskriptif kualitatif untuk melihat presisi data spasial sehingga data dapat dikategorikan sebagai data yang valid. Hasil penelitian menunjukkan bahwa kriteria data bidang tanah yang valid yaitu memenuhi aspek kebenaran letak, bentuk, luas dan standar penomoran, namun masih terdapat bidang-bidang tanah yang berstatus valid di aplikasi Komputerisasi Kegiatan Pertanahan (KKP) belum sesuai dengan kriteria yang diatur dalam Juknis. Dengan demikian akan berpengaruh pada pelaksanaan sertifikat tanah elektronik, karena antara kualitas data dan pelaksanaan sertifikat tanah elektronik merupakan satu kesatuan, data pertanahan yang baik akan menghasilkan kualitas sertifikat tanah elektronik yang dapat memberikan rasa aman dan berkepastian hukum serta tidak mudah digugat, karena data pertanahan hasil dari alih media sebagai dokumen elektronik. The availability of land is the main instrument for national development in Indonesia. However, the massive development activities undertaken by the government and the public often lead to friction over land management, development, security, and control issues. The presence of a land bank agency is expected to be able to guarantee the availability of land under development for public, social, and economic equity. This research aims to analyze the urgency of establishing a land bank agency, the mechanism of land acquisition as a support for national development, its opportunities, and challenges. A qualitative method with descriptive analysis is applied in this research. The primary and secondary data that have been obtained are analyzed descriptively through data reduction, data presentation, and drawing conclusions related to the existence of land bank entities in Indonesia. Take a look at the results of this research, it indicates that the land bank agency is an agency that is capable to answer problems related to land acquisition for development in Indonesia. The implementation mechanism starts from the process of procurement, management, utilization, and distribution of land. The availability of land by the land bank is not only capable to facilitate the investment climate, but also to avoid the swelling of financing in land acquisition, abandonment of land and land disputes. However, this study suggests that a more specific study is needed regarding the process of transferring land rights and coordination between relevant stakeholders in order to fulfill the object. Ketersediaan tanah menjadi instrumen utama untuk pembangunan nasional di Indonesia. Namun, masifnya kegiatan pembangunan oleh pemerintah dan masyarakat sering kali menimbulkan gesekan permasalahan pengelolaan, pengembangan, pengamanan dan pengendalian atas tanah. Hadirnya badan bank tanah diharapkan mampu menjembatani ketersediaan tanah dalam pembangunan untuk kepentingan umum, sosial dan pemerataan ekonomi. Penelitian ini bertujuan untuk menganalisis urgensi pembentukan badan bank tanah, mekanisme perolehan tanah sebagai penunjang pembangunan nasional, peluang dan tantangannya. Penelitian ini menggunakan metode kualitatif dengan analisis deskriptif. Data primer dan sekunder yang telah diperoleh kemudian dianalisis secara deskriptif melalui reduksi data, penyajian data hingga penarikan kesimpulan terkait dengan keberadaan badan bank tanah di Indonesia. Hasil penelitian menunjukkan bahwa badan bank tanah merupakan badan yang mampu menjawab persoalan terkait dengan pengadaan tanah untuk pembangunan di Indonesia. Mekanisme pelaksanaannya dimulai dari proses pengadaan, pengelolaan, pemanfaatan hingga pendistribusian tanah. Ketersediaan tanah oleh badan bank tanah selain mampu memudahkan iklim investasi, juga mampu menghindarkan pembengkakan pembiayaan dalam pembebasan tanah, penelantaran tanah serta sengketa tanah. Namun demikian, penelitian ini menyarankan perlu dilakukan kajian yang lebih spesifik terkait proses peralihan hak atas tanah dan koordinasi antar stakeholder terkait dalam rangka pemenuhan objeknya.
