Introduction: Gender based violence in social media has increased. The term of gender based violence can be found on the result of Convention on the Elimination of all Forms of Discrimination Against Women, however there are still not any proper effort to overcome it yet.Purposes of the Research: Knowing and analyzing gender-based violence on social media..Methods of the Research: This study uses a normative juridical method with legal materials used in the study are primary, secondary and tertiary with the use of literature study techniques in the form of international legal regulations, scientific papers and literature.Results of the Research: There are several forms and types of gender based violence in social media like cyber grooming, hacking, infringement of privacy, malicious distribution, revenge porn, impersonation, defamation, and online recruitment. Hence as the way to overcome it, the efforts that can be used is by penal and non-penal efforts. The penal efforts are the implementation of the integrated criminal justice system with gender justice and the regulatory reform through a bill to accommodate the criminal act of gender based violence. Meanwhile the non-penal efforts are by increasing the awareness and knowledge through the campaign movement against gender based violence in social media and providing the complaint and report service accesses (hotline) that are easy to be accessed and fast to respond.
Tulisan ini membahas isu tentang kekebalan hukum pidana (immunity) dalam kaitannya dengan penanggulangan Covid-19 oleh semua pengambil kebijakan baik itu Komite Stabilitas Sistem Keuangan maupun pengambil kebijakan lain yang berhubungan dengan Covid-19, metode yang digunakan dalam penelitian ini adalah yuridis normatif, dengan pendekatan perundang-undangan, pendekatan konsep yang membahas tentang kekebalan hukum, bahan hukum yang dipakai adalah bahan hukum primer, sekunder dan tersier, teknik pengumpulan bahan adalah studi kepustakaan, serta analisis data yang digunakan analisis kualitatif. Hasil penelitian menemukan bahwa salah satu lambatnya penyerapan anggaran dana bencana dan penanganan lambat adalah prosedur administrasi yang panjang dan pengambil kebijakan takut mengambil kebijakan karena ancaman hukuman mati dalam tindak pidana korupsi. Kekebalan hukum pidana dalam Pasal 27 Ayat (2) Undang-Undang Nomor 2 Tahun 2020 memang perlu ada untuk melindungi pengambil kebijakan, dan sifat kekebalan hukumnya tidak absolut sehingga pengambil kebijakan tidak bisa melakukan kesewenang-wenangan karena harus ada itikad baik dalam mengambil kebijakan atau perbuatan dalam peanggan Covid-19. Kesimpulannya kekebalan hukum dalam penanganan perlu ada untuk melindungi pengambil kebijakan namun harus ada itikad baik dalam pengambilan kebijakan atau perbuatan yang dilakukan. Saran perlu peraturan dibahwa undang-undang yang dapat menjelaskan maksud dari Pasal 27 Ayat (2) Undang-Undang Nomor 2 Tahun 2020.
Perdagangan orang yang dikenal dengan istilah Human Trafficking merupakan kejahatan yang sangat sulit untuk diberantas dan disebut-sebut oleh masyarakat internasional sebagai bentuk perbudakan masa kini dan pelanggaran terhadap hak asasi manusia modern. Kejahatan ini terus berkembang secara nasional maupun internasional yang dapat dikualifikasi sebagai kejahatan transnasional (lintas Negara). Maluku merupakan daerah yang kaya akan sumber daya alamnya ternyata tidak berbanding lurus dengan taraf hidup ekonomi penduduknya. Hal ini berimplikasi pada maraknya kejahatan yang terjadi di Maluku, salah satunya adalah tindak pidana perdagangan orang. Tujuan dari penelitian ini adalah untuk mengetahui modus operandi tindak pidana perdagangan orang di Maluku serta mengetahui kendala dalam penanganan tindak pidana perdagangan orang di Maluku. Metode penelitian yang digunakan adalah penelitian yuridis empiris, dimana peneliti melakukan wawancara dengan para penyidik yang menangani tindak pidana perdagangan orang baik di Polda Maluku, Polres P. Ambon dan P.P Lease, serta Polres Kep. Aru. Berdasarkan hasil penelitian didapati bahwa modus operandi yang dilakukan yaitu dengan merekrut, menampung, yang didahului oleh janji untuk mempekerjakan korban. Kendala dalam penangananan TPPO di Maluku yaitu: Budaya konsumtif dan hedonisme di masyarakat, Kemajuan Teknologi dan Informasi, Adanya bekingan dari segelintir orang yang memiliki kekuasaan, Biaya pemulangan korban TPPO ke daerah asal minim; Ketersediaan rumah singgah bagi korban TPPO belum merata di Wilayah Maluku, terbatasnya anggaran, minimya pemahaman masyarakat tentang TPPO.
Introduction: The pretrial examination only examines the validity of legal procedures in handling cases. The question which one should be the subject of a pretrial case examination, whether the examination of the procedure, or examination of the subject matter.Purposes of the Research: This study aims to analyze and discuss of the essentially examination of pretrial cases an effort to fulfil one’s rights of the suspect according of the criminal procedure code, and Objectivity of pretrial case examination and its presence in the criminal procedure code in the future.Methods of the Research: The type of research is normative legal research. The approach used in this research are the statutory approach, conceptual approach, and case approach. The sources of legal materials used are primary legal materials, secondary legal materials, and tertiary legal materials. The technique of collecting legal materials are through literature study, and analysis of legal materials is qualitative.Results of the Research: The pretrial examination mechanism which is essentially an effort to fulfil one's rights in its implementation is not so broad in the sense that the examination of cases that are substantial (material aspects) in the context of actual prove of a procedure law enforcement. To obtain a material truth, the judge in examining existing pretrial case, has not been able to explore the truth in assessing any evidence submitted by the applicant and the respondent in a pretrial case, which also means that in some pretrial case examinations, judge are still limited to pretrial examination, namely regarding the procedure as stipulated in article 77 of the Criminal Procedure Code.
Introduction: This study discusses the legal protection of child victims of online prostitution through the MiChat application Purposes of the Research: Reviewing and discussing forms of legal protection for children who are victims of online prostitution through the MICHAT application and efforts to overcome online prostitution against children. Methods of the Research: This research uses the juridical normative method by using a statutory approach, a conceptual approach, and a case approach. Results of the Research: The results of the study show that online prostitution of children through the Michat application is on the rise, the lack of coordination between agencies, and the lack of legal awareness in this case law enforcement officers, KPAI, NGOs, parents, and other community institutions, causing the handling of cases of online prostitution crimes. not maximal. Preventive efforts and repressive efforts carried out by law enforcement officers have not been able to provide maximum legal protection to children who are victims of online prostitution. Thus, mitigation efforts must be carried out optimally, in order to provide legal protection to children who are victims of online prostitution through the MiChat application
