This study aims to develop a Theory of Planned Behavior by analyzing the factors that influence customers to contribute to Islamic P2P lending customers. This study uses a partial least squares structural equation model (PLS-SEM) analysis with 120 respondents. The number of respondents is determined by the five rules of thumb approach, while data collection is done by purposive sampling. This research was conducted for one year, namely in 2021-2022 with the provision that the sample was customers of Islamic P2P lending in Indonesia. The results of the study revealed that attitude, subjective norm and perceived behavior control had a significant positive effect on the intention to contribute to Islamic P2P lending. While piety and intention have a significant positive effect on behavior to contribute to Islamic P2P lending in Indonesia. The results of this study contribute to the development of the theory of planned behavior (TPB), more extensive research is needed such as research in countries that are members of the OIC to validate these results. Pada Dasarnya transaksi jual beli dalam penentuan akadnya, pihak yang bertransaksi memiliki hak untuk meneruskan atau membatalkan sebuah akad. Sebuah solusi dalam Islam, menawarkan adanya hak khiyar. Khiyar diperlukan dalam sebuah transaksi untuk menjaga kepentingan, kemaslahatan dan kerelaan kedua belah pihak serta melindungi dari bahaya yang mungkin menimbulkan kerugian. Tujuan dari penelitian ini untuk mengetahui Konsep Khiyar dalam Transaksi Ba’i Salam. Adapun Penelitian ini bercorak kepustakaan karena semua sumber datanya berasal dari sumber-sumber tertulis yang berkaitan langsung atau tidak langsung dengan materi yang dikaji. Data Penelitian diperoleh dengan beberapa literature yang berhubungan dengan masalah yang diangkat kemudian rnengkaji serta menelaah data-data yang ada. Kesimpulan yang didapat, bahwa menurut fiqih muamalah, konsep khiyar yang bisa diterapkan dalam praktik ba’i salam adalah konsep khiyar aib saja. konsep khiyar aib terjadi jika ada cacat yang barang baru diketahui oleh pembeli setelah akad dilakukan dan sebelum serah terima. Dan aib atau cacat pada barang yang dipesan ini masih ada sampai terjadinya pembatalan akad. Sedangkan untuk khiyar syarat dan ru’yah sebenarnya dalam ba’i salam tidak perlu, karena menurut fiqih muamalah jika pemesanan memiliki hak khiyar, maka barang akan menjadi tanggungan penjual, begitu seterusnya, cukup hanya menyebutkan spesifikasi barang untuk keabsahan akad salam. Namun, untuk khiyar aib tetap diperbolehkan, karena karena khiyar aib tidak mencegah kesempurnaan serah terima barang.
Equity crowdfunding is a new innovation in finance, which is an external product of financial technology, by combining financial systems with information technology. Equity crowdfunding is a combination of investment business model with information technology, where meetings between investors and fund managers are conducted online through websites on this platform. Crowdfunding equity platform is now growing rapidly and is very popular among the community, due to some of the facilities offered by the platform organizers for service users. Therefore, further research needs to be done on this business practice, which covers all aspects of the mechanisms and systems on this platform. The purpose of this study is to determine the mechanisms and systems of all aspects of the investment cooperation agreement model applied on the equity crowdfunding platform. The intended aspects include the mechanism of agreement (contract), profit sharing system, user protection, stock trading mechanism, dispute resolution, risk management, and so on. Furthermore, it aims to determine its compliance with Islamic law and the positive laws that apply in Indonesia. Investment agreements on equity crowdfunding platform can be implemented in mudharabah agreement, meanwhile, the agreement between the crowdfunding service provider and the crowdfunding user can use the wakalah bil ujrah contract. The percentage to revenue ratio Muhammad Irkham Firdaus, et.al Journal AL-IKTISAB can use the profit and loss distribution system and the revenue distribution system according to the agreement. Equity crowdfunding platform should really pay attention to consumer protection in accordance with the provisions in accordance with POJK and hifdzul maal theory. In addition, it must carry out risk management to minimize the occurrence of losses for some parties, and create a dispute resolution mechanism in accordance with Islamic law and economic law.
Tabzir behavior is a form of deviation in economic behavior, especially consumption. The purpose of this study is to describe the concept of tabzir in Islamic economic studies and to provide an ideal behavioral offer for consumer behavior. The research method used is qualitative-descriptive-library. Data were collected by documentation method, then processed by data editing and compilation method. Next, the analysis process was carried out by deduction method using the concept of tabzir in Islamic economic studies. Conclusions drawn from this study. First, tabzir behavior is a form of malpractice and deviation in economic behavior, especially in consumption. Second, the law of tabzir behavior for certain definitions is haram. Third, the wisdom avoid of tabzir behavior is to build an awareness of collective solidarity, avoid debt, disorientation of life loss of critical power and economic education. The social concept about consumption based on sharia is a social care which concern on tauhid and love for fellow human beings, thus forming a just and civilized society.
