O artigo em tela tem por objetivo realizar uma análise sobre o surgimento e desenvolvimento da cidadania de crianças e adolescentes no Brasil. Através de referenciais teóricos clássicos do pensamento político brasileiro e de abordagens de curto-alcance, buscamos entender o complexo processo de garantia de direitos, e mudanças de paradigmas no que se refere a estes sujeitos. Apesar de grandes avanços com a implementação do Estatuto da Criança e do Adolescente e todo seu aparato burocrático-administrativo, as heranças da velha política social menorista, de manutenção das desigualdades socioeconômicas, persistem simultaneamente com a concepção de uma infância universal. Longe de apresentar uma saída para tal dualidade, este artigo serve de aporte teórico para novas reflexões
Crianças e adolescentes foram e são, atualmente, objetos de diversos estudos e destinatários de políticas sociais no Brasil, desde o final do século XIX. Na medida em que os conceitos científicos e as interpretações jurídicas se transformam ao longo da história, as representações sociais destes sujeitos também sofrem mudanças. Paralelamente, os paradigmas da sociedade brasileira também se transformam e geram desafios, que necessitam de um amplo debate. O presente artigo tem por objetivo, realizar uma reflexão sobre as representações sociais de crianças e adolescentes nas legislações brasileiras que tratam da defesa de seus direitos. Mais especificamente, importa analisar as transformações no campo jurídico e na lógica das relações sociais empreendidas desde a primeira legislação destinada para a infância – o Código de Menores de 1927, até os dias atuais. Sobretudo, buscamos enfatizar a mudança trazida com a promulgação do Estatuto da Criança e do Adolescente – ECA. Neste sentido, com o relato da história das legislações específicas sobre estes sujeitos, juntamente com o levantamento bibliográfico do tema, analisaremos os desafios dos mesmos em conviver com representações sociais paradoxais – menores e crianças e adolescentes – no atual contexto pós-ECA
