Simbiose institucional refere-se a uma relação continuada ao longo do tempo, que envolve pelo menos dois atores institucionais (Bogéa, 2018). Essa interação não assume de forma apriorística natureza de cooperação absoluta ou de harmonia permanente entre os agentes; porém, é definida como um jogo de soma positiva, i.e., em que ambos têm como propósito obter outcomes. Se, no campo da biologia, "most symbiotic mutualisms involve the supply of energy from one partner on the other" (Boucher et al., 1982, p. 319), no campo da política, os atores em simbiose tendem a tentar extrair da relação algum tipo de vantagem para a construção de seu papel institucional.Parto da premissa teórica de que a relação entre STF e partidos configura uma simbiose institucional. Nessa interação, há ganhos potenciais que partidos poderiam extrair, em particular no tocante à ativação da Corte, para decidir sobre temas de seu interesse. A existência de canais institucionais de acesso direto ao mais alto espaço decisório do Poder Judiciário confere ferramenta de peso a agremiações partidárias. Menos evidente, em um primeiro momento, seriam os benefícios extraíveis pelo Tribunal dessa interação. É de se destacar, a esse respeito, que os próprios juízes da Suprema Corte foram contrários, durante a Constituinte, ao estabelecimento de novos mecanismos que permitiriam a partidos políticos a ativação direta do colegiado (Koerner e Freitas, 2013, p. 165).
Steffen Ganghof’s Beyond Presidentialism and Parliamentarism: Democratic Design and the Separation of Powers (Oxford University Press, 2021) posits that “in a democracy, a constitutional separation of powers between the executive and the assembly may be desirable, but the constitutional concentration of executive power in a single human being is not” (Ganghof, 2021). To consider, examine and theorise about this, Ganghof urges engagement with semi-parliamentarism. As explained by Ganghof, legislative power is shared between two democratically legitimate sections of parliament in a semi-parliamentary system, but only one of those sections selects the government and can remove it in a no-confidence vote. Consequently, power is dispersed and not concentrated in the hands of any one person, which, Ganghof argues, can lead to an enhanced form of parliamentary democracy. In this book review symposium, George Tsebelis, Michael Thies, José Antonio Cheibub, Rosalind Dixon and Daniel Bogéa review Steffen Ganghof’s book and engage with the author about aspects of research design, case selection and theoretical argument. This symposium arose from an engaging and constructive discussion of the book at a seminar hosted by Texas A&M University in 2022. We thank Prof José Cheibub (Texas A&M) for organising that seminar and Dr Anna Fruhstorfer (University of Potsdam) for initiating this book review symposium.
A ideia de representação argumentativa constitui resposta recente à objeção democrática ao papel político exercido por tribunais constitucionais. A tese defende que o juiz pode ser concebido como um representante popular, com legitimidade democrática tão sólida quanto os funcionários eleitos do Legislativo ou do Executivo. Cuida-se de movimento que participa do contexto teórico de expansão dos sentidos da representação para instâncias não-eleitorais, como instituições participativas da sociedade civil, conselhos ou movimentos sociais. Neste artigo, colocamos em escrutínio essa construção teórica, bem como apontamos os problemas associados à sua incorporação em votos e escritos de ministros do Supremo Tribunal Federal. Concluímos que o argumento padece de fragilidades insuperáveis associadas à crença exacerbada no potencial deliberativo de tribunais, à ausência de mecanismos de aproximação entre pretensos representantes e seus representados e à ausência de mecanismos efetivos de accountability. Além disso, indicamos como a tese pode ser manejada para fins de blindagem discursiva de decisões politicamente salientes e controversas. Reforçamos, assim, o caráter elitista dessa tentativa, que exacerba o isolamento da corte em relação a seus ditos representados e firma um distanciamento crescente do núcleo essencialmente democrático da soberania enquanto exercício popular do poder político.
