A közjavaknak jól meghatározható tulajdonságaik vannak. Leginkább a rivalizálásés kizárás tilalma köré csoportosulnak. A közjószágok fogyasztásából kezeléséből, fenntarthatóságából fakadó problémák nemzeti és nemzetközi megoldásokat egyaránt indukálnak. Nemzeti, mert egy adott országhoz tartozó, nemzetközi, mert valamennyi állam rendelkezik ilyen javakkal, és mert országokon átívelő, helyenként közös használaton, megegyezéseken, szabályokon alapulnak. A rossz gazdálkodás, káros túlfogyasztás, elővigyázatlanság externális folyamatokat is generál. Ezek nem piacon közvetített hatások. Itt keletkezik egy paradox helyzet, ugyanis a közjavak ugyan piaci kategóriák (mindenkit érintenek, nincs kizárás), bizonyos keretfeltételek között mindenki számára hozzáférhetők, nem rivalizálhatók, etc., az externáliák pedig látens piaci kapcsolatok, kezdetben a "partnerség" sem ismert. Mégis öszszekapcsolt a két kör, mert az ember, mint ökológiai (és környezetét befolyásoló, átalakító) lény nem tudott a bekövetkező káros események előzményeiről, de hadd fordítsam meg, a környezet sem lett felkészítve a befogadásra, vagy nem lett figyelembe véve, hogy alkalmatlan a behatásokra és annak következményeire. Az ezekkel kapcsolatos aktuális hazai normákat, szabályozókat szeretném bemutatni, főleg figyelemfelkeltő szándékkal. Bevezetés A közjószágok problematikája végig kíséri az emberi evolúciót évszázadok óta. Ezeket a javakat az állam hivatott főként mesterségesen előállítani, a társadalom bizonyos tagjainak garanciákat nyújtva, legalább minimális szükségletük kielégítésére. Természetes formában is előfordulnak, csak egyre korlátozottabb volumenben. Ahogy az emberiség fejlődött az utóbbi évtizedekben, egyre koncentráltabbá vált a környezetszennyezés, a pazarló és káros fogyasztás, ami annak is következménye lett, hogy a világon, a világgazdaságban egy túlkínálatos, a fogyasztókat sok esetben erőszakosan befolyásoló, globális piac bontakozott ki.
