Organ shortage constitutes an unsolved problem for every country that offers transplantation as a therapeutic option. Besides the largely implemented donation model and the eventually implemented market model, a theorized automatic organ procurement model has raised a rich debate in the legal, medical and bioethical community, since it could show a higher potential to solve organ shortage. In this paper, we study the main arguments for and against this model. We show how, in the light of empirical data extracted from countries with a universal health care system, its implementation could lead to a positive impact on organ procurement rates. Three factors are envisioned as fundamental in the comprehension and a possible regulation of the automatic organ procurement model: the lack of recognition of the conscientious objection, the preservation of the right to choose end of life conditions, and the need to avoid incentives for families or healthcare professionals.
En este trabajo analizamos los argumentos a favor y en contra del que hemos denominado modelo de obtención automática en relación con los órganos de fallecidos. Para ello aportamos datos empíricos que permiten valorar su potencial impacto en las cifras de donación y en la opinión pública. Específicamente, por un lado, examinamos las razones que lo respaldan, haciendo especial referencia a aquellas relativas a la utilidad y la justicia. Por otro lado, estudiamos las manifestaciones que se oponen a este modelo teórico fundadas en la vulneración de intereses pre mortem y post mortem, y en el rechazo que generaría en la población. Por último, a modo de conclusión, subrayamos los aspectos que, a nuestro juicio, deberían regularse exhaustivamente si se implantase. En particular, nos referimos al estatuto jurídico del cuerpo humano, al trato al paciente en la última etapa de su vida, a los incentivos para los profesionales sanitarios y al reconocimiento del derecho a la objeción de conciencia.
En 2020 se ha cumplido el vigésimo aniversario del Protocolo de Palermo contra la trata de personas. Desde su aprobación, y especialmente en los últimos diez años, son muchos los países que han tipificado penalmente este fenómeno o han reformado su regulación en este ámbito. Entre ellos se encuentran los Estados cuyas legislaciones conforman el objeto de la primera parte del trabajo: Alemania, Argentina, Chile, Colombia, España, Francia, Italia, México, Reino Unido y Uruguay. Sin embargo, a pesar de haber firmado y ratificado todos ellos este instrumento normativo internacional, no se ha alcanzado la pretendida armonización legislativa. Por el contrario, se pueden distinguir hasta cuatro tendencias político-criminales distintas con importantes repercusiones en la determina ción del bien jurídico protegido a las que se dedica la segunda parte del trabajo.
Resumen: El objeto de este trabajo consiste en un estudio comparado de las más recientes disposiciones sancionadoras del tráfico de órganos humanos incorporadas a la legislación de Chile y España. Para ello, se parte de la normativa que proclama el principio de gratuidad en materia de trasplantes, y se analizan las infracciones administrativas y penales previstas para sancionar, sobre todo, las conductas que se cometan en este ámbito con ánimo de lucro. Este estudio comparado permitirá conocer, por un lado, las principales notas comunes a ambos ordenamientos jurídicos, así como aquellas otras en las que divergen; y, por otro lado, los aspectos más problemáticos que plantea la aplicación de dichas normas sancionadoras. Tanto las discrepancias entre estas legislaciones como las dificultades que plantea su aplicación reflejan la complejidad para afrontar jurídicamente este problema de una forma satisfactoria.Palabras clave: tráfico de órganos humanos -derecho comparado -conflicto de normascomercio de órganos humanos -trata de personas Abstract: The objective of this paper consists of a compared study of the most recent penalty provisions about trafficking in human organs incorporated to the Chilean and Spanish legislations by assuming the regulations that proclaim the principle of free provision in the field of organ transplants, and analyzing administrative breaches and criminal offences provided in order to sanction above all the conducts committed in this area with the aim of getting economic benefit. This compared study will show, on the one hand, the main common aspects of both legal systems, as well as the divergent points; and, on the other hand, the most problematic aspects posed by the implementation of those penalty provisions. El pasado 25 de junio de 2021 entró en vigor la mayor parte del contenido de la Ley Orgánica 8/2021, de 4 de junio, de protección integral a la infancia y la adolescencia frente a la violencia (en adelante, LO 8/2021). Esta norma, siguiendo el modelo de una ley marco de protección integral, modifica hasta quince cuerpos normativos a través de sus disposiciones finales 1 con el propósito de «garantizar los derechos fundamentales de los niños, niñas y adolescentes a su integridad física, psíquica, psicológica y moral frente a cualquier forma de violencia, asegurando el libre desarrollo de su personalidad y estableciendo medidas de protección integral, que incluyan la sensibilización, la prevención, la detección precoz, la protección y la reparación del daño en todos los ámbitos en los que se desarrolla su vida» (art. 2) 2 . Entre las reformas más sustanciales se encuentran las que afectan al Código penal (en adelante, CP) y a la Ley de Enjuiciamiento Criminal (en adelante, LECrim), sobre las que versa el presente trabajo 3 . La investigación victimológica ha acreditado que los menores de edad tienen, por lo general, una mayor propensión victimal, sobre todo en el ámbito familiar, por su indefensión 4 , de manera que suelen ser considerados «víctimas ideales» 5 . También tienen más dificultades para sobreponerse a la victimización primaria, aumentando las secuelas que derivan del delito a largo plazo.
