Este artigo apresenta uma revisão bibliográfica da história do saneamento básico no Brasil e sua regulação. Foi realizado por meio de referências que abordam desde o período de colonização até a atualização da Lei nº 11.445/2205, conhecida como o Marco Legal do setor, por meio da Lei nº 14.026/2020, apresentando os decretos publicados até o ano de 2023. A história das políticas públicas de saneamento no Brasil demonstra a transformação de uma atividade que se iniciou de modo incipiente, baseada em soluções individuais apropriadas à época, chegando a arranjos complexos de soluções coletivas que utilizam modelos de prestação pública e privada. Apesar dos avanços, desafios persistem, como a falta de acesso adequado à água tratada e ao esgotamento sanitário que ainda afeta muitas pessoas. A regulação precisa ser aprimorada e padronizada para abranger todos os municípios, e colaborar para uma gestão holística que considere a saúde, o meio ambiente e o direito à água. O estudo contribui para a criação de um registro histórico sobre o saneamento básico no Brasil, fornecendo um contexto relevante para pesquisas futuras e o desenvolvimento de políticas públicas eficazes.
The presence and contamination of groundwater by nitrate is still a little studied subject mainly focusing on public health. Thus, this work aims to identify and evaluate the sources of nitrate contamination of drinking water in Minas Gerais and São Paulo, based on field research and analyzes of the Water Quality Surveillance Information System for Human Consumption ( Sisagua), which is a tool of the National Water Quality Surveillance Program (Vigiagua) to manage the health risks associated with the quality of water intended for human consumption. The results of the evaluation of nitrate concentrations in the waters distributed and consumed by the population in Minas Gerais come mainly from pastures, followed by crops, in São Paulo predominantly from industries followed by pastures.
Os conflitos pela água são decorrentes da grande demanda hídrica, cada vez mais frequente, devido à diminuição do abastecimento em todo o mundo. No Brasil, os conflitos são declarados em várias bacias hidrográficas, cenário que colocou diversas regiões em situação de escassez hídrica. Assim, o objetivo do estudo foi avaliar indícios de conflitos pela água na bacia do rio Paracatu, o que se justifica pela necessidade de aprofundar conhecimentos, visto que o país possui uma das maiores reservas de água doce do mundo e apresenta inúmeras situações de extrema escassez e dificuldade de acesso desse o recurso. A pesquisa envolveu a lista de declarações de áreas de conflitos na bacia, os levantamentos de outorgas e usos insignificantes e a análise do Plano Diretor de Recursos Hídricos (PDRH). Dessa forma, os resultados mostraram que o PDRH da bacia do Paracatu não foi atualizado conforme recomendado, além de não apontar diretamente o potencial de indisponibilidade hídrica na região. Além disso, houve um aumento de 66% de concessões com uma relação crescente com o número de Declarações de Áreas de Conflitos (DAC) emitidas. Os conflitos gerados pela escassez hídrica influenciam significativamente as condições socioambientais da bacia, onde, a maioria dos municípios da própria bacia se encontram em situação de extrema pobreza, de acordo com os índices econômicos atualmente utilizados. Portanto, o estudo identificou a existência de cinco cursos d'água com conflitos declarados, demonstrando a necessidade de planejamento e melhoria da gestão do uso da água para garantir o abastecimento desse recurso para as atuais e futuras gerações. The Generation of Conflicts over Water Use in the Paracatu River Basin, Northwest of Minas Gerais, Brazil A B S T R A C TConflicts over water originate from the high-water demand, which has been increasingly frequent due to the decrease in water supply worldwide. In Brazil, conflicts are declared in several hydrographic basins; scenario that put several regions in a situation of water scarcity. Thus, the objective of the study was to evaluate evidence of conflict over water in the Paracatu River basin, justified by the need to deepen knowledge, since the country has the largest freshwater reserve in the world and experiences situations of extreme scarcity and difficulty in accessing the resource. The research involved the list of conflict area declarations in the basin, survey of grants and insignificant uses and analysis of the water resources master plan. Thus, the results showed that the water resources development plan for the Paracatu basin was not updated as recommended, in addition to not directly pointing out the potential for water unavailability in the region. In addition, there was a 66% increase in the number of grants with an increasing relationship to the number of DAC’s issued. Conflicts significantly influence the socio-environmental conditions of the basin, where most municipalities are in extreme poverty. In conclusion, the work identified the existence of five water courses with declared conflicts, demonstrating the need for planning and improving water use management to guarantee the supply of this resource for the current and future generations.Keywords - Water Demand, Conflict Area Declaration, Irrigation
Em vários países o preço da água pode e melhorou quantitativa e qualitativamente a distribuição deste recurso. O preço adequado e bem utilizado levou a uma melhor sustentabilidade e conservação da água por meio de regulamentos prescritivos, incluindo até o racionamento de água. O uso de preços para gerenciar a demanda de água é mais econômico do que a implementação de programas de conservação sem preços. No Brasil, através de instrumentos legais, é prevista a cobrança pelo uso dos recursos hídricos, sinalizando pela necessidade do reconhecimento do valor econômico da água associado ao seu uso, ao desenvolvimento sustentável mediante aos desafios da escassez hídrica futura. Para que a cobrança pelo uso da água não se torne um mero mecanismo de arrecadação pública, e devido também, a inexistência de estudos que investiguem e expressem de forma clara os objetivos e finalidades da cobrança em Minas Gerais, esta pesquisa se fez necessária. Desta forma, este trabalho objetivou investigar e avaliar a cobrança pelo uso da água e sua eficácia na melhoria do Índice de Qualidade da Água (IQA) estabelecida pelo órgão gestor. Em Minas Gerais, de 91,67% das Unidades de Planejamento e Gestão de Recursos Hídricos (UPGRHs), onde existe a cobrança instituída, não se constatou uma tendência na melhoria do IQA. Apenas 36,36% das bacias estaduais que cobram pelo uso da água melhoraram os níveis de IQA, enquanto 63,63% pioraram ou não tiveram variação significativa. The appropriate and well-used price has led to better sustainability and conservation of water through prescriptive regulations, including even water rationing. Using prices to manage water demand is more economical than implementing price-free conservation programs. In Brazil, through legal instruments, charging for the use of water resources is foreseen, signaling mainly the need to recognize the economic value of water associated with its use, sustainable development through the challenges of future water scarcity. So that, charging for the use of water does not become a mere mechanism for public collection, and also due to the lack of studies that investigate and clearly express the objectives and purposes of charging in Minas Gerais state, this research was necessary. Thus, this study aimed to investigate and evaluate the charge for water use and its effectiveness in improving the Water Quality Index (WQI) established by the managing body. In Minas Gerais, of 91.67% of the Water Resources Planning and Management Units (UPGRHs), where the collection is in place, there was no trend in improving the IQA. Only 36.36% of the state basins that charge for the use of water improved the levels of IQA, while 63.63% worsened or had no significant variation.Keywords: Water scarcity. Water availability. RESUMO O acesso à água e ao esgotamento sanitário é fundamental para o combate à transmissão da COVID-19. Nesse contexto, o objetivo do estudo foi avaliar as condições de abastecimento de água, coleta e tratamento de esgoto nos municípios com maior número de casos de COVID-19 no Brasil, considerando-se ainda, o papel da regulação e o desafio de atingir as metas do Objetivo de Desenvolvimento Sustentável (ODS) 6. A pesquisa justifica-se pela natureza inédita da promoção do conhecimento por meio de dados entre esses fatores. Inicialmente, o trabalho correlacionou o ODS 6 com o abastecimento de água e esgotamento sanitário por meio de indicadores do Sistema Nacional de Informações sobre Saneamento (SNIS), cruzando os dados com os municípios com mais casos de COVID-19 para a avaliação da performance e do papel da regulação. Assim, observando-se as cidades com maior número de casos confirmados de COVID-19, ficou evidente a ligação entre a pandemia e o ranking dos piores indicadores de água e esgoto. A falta desses serviços por si só não promove a doença, mas é um dos fatores que dificulta as medidas preventivas e pode favorecer sua dispersão, indicando a fragilidade das condições de saúde nesses locais. As porcentagens alcançadas foram de 45% para o ODS 6.1, de 25% para os ODS 6.2 e 6.3 e de 0% para o ODS 6.4, afetando principalmente as comunidades desfavorecidas com a maior proporção de casos confirmados de COVID-19. Diante disso, as agências reguladoras precisam transformar os indicadores de continuidade do abastecimento de água e esgoto no Brasil, condição aplicável aos países em desenvolvimento.
