O presente artigo investiga a aplicabilidade do princípio da função social da propriedade, garantido e reforçado pela Constituição Brasileira de 1988, ante a criação de unidades de conservação, de forma mais específica, de Reservas Particulares do Patrimônio Natural (RPPN). Por meio de uma metodologia de natureza básica, de caráter objetivo descritivo e utilizando-se dos procedimentos bibliográfico e documental, o estudo relata brevemente a evolução do princípio, a mudança na mentalidade sobre a propriedade privada, assim como aborda a importância da proteção ambiental, e sugere o conceito de função socioambiental como uma combinação mais inteligente. Tem como objetivo responder aos questionamentos: A criação de Unidades de Conservação (UC) consiste em um ato contrário ao princípio da função social da propriedade? E, se a instituição de uma UC for motivada pela livre-iniciativa do proprietário da terra, como no caso da RPPN, a função social da propriedade continuará sendo atendida? Como resultado, concluiu-se que, a criação de uma UC e o princípio constitucional abordado não são mutuamente excludentes e, mesmo no caso da RPPN, o princípio continuará sendo atendido.
With the expansion of environmental consciousness and the growth of nature loss awareness, people, governments, organizations and companies are devoted to achieve sustainable development. Businesses around the globe are facing the challenge of minimizing environmental impact, improving social responsibility, attending governance standards and, mostly, keeping the company financially stable. In order to achieve that goal, many are counting on offsetting schemes, most known as a way to compensate for biodiversity loss with environmentally positive initiatives. This article aims to analyze from an ESG perspective whether these initiatives effectively bring environmental benefits or are just a form of self-promotion and greenwashing. The study was conducted using bibliographic analysis, conceiving a small review on the subject matter. In conclusion, this article intends to serve as motivation for the debate and investigation of sustainable practices.
