RESUMENEl presente artículo analiza la biografía y producción literaria de Fernando de Vera y Mendoza, autor al que ya desde el siglo XVII le fue atribuida la autoría de un tratado sobre teoría poética titulado Panegírico por la poesía, aparecido en Montilla (Córdoba) el mismo año de la muerte de Luis de Góngora; las difíciles relaciones que este autor mantuvo con su padre, un personaje poderoso en la vida política de la España de ese momento histórico, nos han servido de base para justificar la anonimia de un texto marcado desde sus orígenes por la ambigüedad en su atribución.Palabras Clave: Panegírico por la poesía, Fernando de Vera y Mendoza, conde de la Roca, anonimia, Montilla, teoría poética. ABSTRACTThis article reviews Fernando de Vera y Mendoza's biography and literary production. From the seventeenth century the authorship of a treatise on poetic theory titled Panegírico por la poesía which appeared in Montilla (Córdoba) the same year as Luis de Gongora's death, was attributed to this writer. Key wordsFernando de Vera y Mendoza; Panegírico por la poesía; Greek and Latin Classics; Imitation; Plagiarism; Erudition Procedencia de las fuentes de clásicos grecolatinosLa portada del Panegírico por la poesía (1627) ostenta un escudo, grabado en cobre, que sirvió a La Barrera como dato incuestionable para la atribución del opúsculo a Fernando de Vera y Mendoza, hijo primogénito del conde de la Roca. Dicho grabado tiene por emblema un águila como símbolo de nobleza, de cuyo pico sale la sentencia «Veritas vincit»; el ave sostiene el escudo de los Vera y se apoya sobre un medallón que representa un campo de flores libadas por una abeja, y en cuyo círculo se lee la explicación de la imagen (suscriptio): «Brevis in volatilibus apis et initium dulcoris habet fructus illius» («Insignificante es la abeja entre los que vuelan y, sin embargo, su fruto es el origen del dulzor»). La imagen de la abeja, que vuelve a aparecer en el período quinto del Panegírico, se ofrece, por un lado, como símbolo de un animal que aporta dulzura con su trabajo y, por otro, como representación del esmero y delicadeza en la realización del mismo, y se identifica con la figura del poeta, cuya creación aporta un edulcorante en los momentos difíciles, de ahí su conexión con la medicina (poesía como «eficacísimo galeno», en palabras de Vera); por otro lado, conforme al ideal humanista, el poeta se muestra como un recreador y reactualizador de doctrinas antiguas que certifican su dignificación, de las que, cual la abeja, va seleccionando y recreando su propia obra. Como vemos, Vera nos ofrece ya desde la portada las claves de su obra. El símil del poeta y la abeja era frecuente en libros de hieroglífica y emblemática; así, se contiene en el capítulo «Poeticae amoenitas» de la Hieroglyphica de Piero Valeriano, en el que cita a autores latinos como Horacio, quien en el libro IV, 2, de sus Odas (2005: 170) se comparaba a sí mismo con la figura de la abeja:La erudición en Vera: ¿imitación o plagio? 119 Studia Aurea, 6, 2012 Una poderosa aura, Antonio, eleva al cis...
El presente artículo analiza la exigencia normativa referida al procedimiento administrativo en vía de regreso sobre los docentes cuando estos incurren en dolo, culpa o negligencia graves en el ejercicio de su labor y como consecuencia de ello se produce un daño antijurídico a un tercero, del que se deriva una responsabilidad patrimonial de la Administración Pública. Se analizan los requisitos para el ejercicio de la acción de repetición de la Administración sobre el personal a su servicio y se reflexiona sobre los motivos que pudieran motivar lo que en la actualidad se ha convertido en una manifiesta inaplicación práctica de una norma administrativa en general, y en el ámbito de la enseñanza pública en particular.This article analyzes the normative requirement referred to the administrative procedure in way of return on the tea chers when they commit serious fraud, fault or negligence in the exercise of their work and as a consequence there is an unlawful damage to a third party, of which a patrimonial responsibility of the Public Administration is derived. The requirements for the exercise of the action of repetition of the Administration on the staff at its service are analyzed and the reasons that might motivate what at present has become a manifest practical non-application of an administrative rule in general are analyzed and in the field of public education in particular.
