O presente artigo pretende demonstrar como � t�nue e sens�vel a linha que separa a efetividade da inefetividade do princ�pio da igualdade no Brasil ap�s tr�s d�cadas da promulga��o da Constitui��o Federal. Com o objetivo de refletir sobre a aplica��o pr�tica desse princ�pio, utilizou-se o m�todo de estudo bibliogr�fico sobre a igualdade e os direitos das minorias, em especial negros e homossexuais. Por meio de uma abordagem a respeito da discrimina��o racional, o fator discriminat�rio entra em contraste com a intoler�ncia sem fundamentos acarretando a estigmatiza��o das minorias. Nessa pesquisa, restou sedimentada a necess�ria mudan�a social, por meio de uma democracia s�lida, para dirimir os preconceitos enraizados culturalmente. Questionou-se, pois, se o princ�pio da igualdade tem sido efetivamente respeitado, se o ordenamento jur�dico brasileiro consegue extrair do seu n�cleo axiol�gico a melhor e mais extensa prote��o a todos os cidad�os brasileiros, bem como se, diante da omiss�o do Poder Legislativo, como deve ser tutelado os direitos dos grupos minorit�rios. Tais quest�es s�o debatidas analisando algumas legisla��es e decis�es do Supremo Tribunal Federal no seu papel contramajorit�rio de garantir os direitos fundamentais para esses grupos nos casos de legisla��o omissa.
