Najvažniji zahtjev vladavine prava je da ljudi na pozicijama vlasti treba da vrše svoju vlast unutar ograničavajućeg okvira dobro ustanovljenih javnih normi, umjesto na proizvoljan, ad hoc ili čisto diskrecioni način. Vladavina prava se utjelovljuje stabilnim ustavom koji se sastoji od formalnih pravila putem kojih se ograničavaju upravljačka ovlašćenja na osnovu zakonu. Pored sudova, za vladavinu prava je važno i obezbjeđenje poštovanja zakona i podsticanje izvršenja sudskih odluka od strane vladinih službenika. Upravo zbog toga, zakonodavstva u razvijenim demokratijama propisuju krivično djelo „Neizvršenje sudske odluke“ prema kojim se kažnjivim ponašanjem smatraju radnje odgovornog službenika koji odbije da izvrši pravnosnažnu presudu. Nezavisnost pravosuđa je kičma vladavine prava, dok nezavisnost sudija štiti nezavisnost pravosuđa u cjelini. Nepristrasnosti u odlučivanju sudije znači da je neophodno da sudije djeluju bez bilo kakvih ograničenja, nedoličnog uticaja, pritiska, prijetnje ili miješanja, neposrednog ili posrednog, od strane bilo kog autoriteta, uključujući autoritete unutar pravosuđa. Međutim, finansijska nezavisnost pravosuđa je još uvijek ograničena i uslovljena postupkom odobravanja budžetskih sredstava dodijeljenih pravosuđu od strane ministarstava finansija, što pravosudne organe čini zavisnim od vladajućih politika i omogućava korupciju u pravosuđu ili uticaj politike na rad pravosuđa. Reforma pravosudnog sistema moguća je samo ukoliko građani osjećaju njene benefite i pokazuju zadovoljstvo postignutim rezultatima. Sudeći prema percepciji građana, korupcija je najdominatnija u sistemu zdravstva i među političkim partijama, zbog čega Agencija za borbu protiv korupcije BiH treba pojačati svoje napore budući da je sprječavanje korupcije na visokom nivou direktno pod njenom nadležnošću. Upravo zbog toga, u namjeri da se predstavi negiranje vladavine prava u Bosni i Hercegovini, koristiće se studije slučaja koji predstavljaju sekundarnu viktimizaciju žrtava i ukazati na indikatore postojanja vladavine prava, a to su: poštovanje zakona, nezavisnost pravosuđa i odsustvo korupcije.
Rad se bavi nekim pitanjima reforme sistema zaštite žrtava krivičnih djela i posebno žrtava nasilja u porodici u Bosni i Hercegovini, i to u kontekstu dosljedne implementacije kako Istanbulske konvencije, tako i Preporuke Evropske unije u vezi sa minimumom zaštite, podrške i pomoći žrtvama krivičnih djela iz 2012. godine (PUP, 2012). Polazna osnova su istraživanja koja su utvrdila da je žrtvama nasilja u porodici u Bosni i Hercegovini uskraćen pristup pravosuđu. Naime, poslije podnošenja prijave o nasilju u porodici, policija može ali nije obavezna da o tome obavijesti tužioca - sve dok ne prikupi dovoljno dokaza i ne procijeni da je riječ o krivičnom djelu. Sekundarna viktimizacija žrtava nasilja u porodici u Bosni i Hercegovini vrši se i kroz pogrešno klasifikovanje nasilja u porodici kao prekršajnog, a ne krivičnog djela, ali i kroz neprovođenje krivične istrage u skladu sa zakonom. Marginalizacija žrtava nasilja u porodici vrši se i kroz blago kažnjavanje nasilnika, te i kroz uskraćivanje prava žrtve na restituciju. Žrtva nasilja u porodici ima pravo da bude zbrinuta u sigurnu kuću radi osiguranja fizičke zaštite i ostvarivanja svojih prava i interesa što može da predstavlja njihovu ponovnu sekundarnu viktimizacija. S tim u vezi, žrtva nije prekršila zakon, već nasilnik koji treba biti „udaljen iz porodične kuće“ jer je ugrozio sigurnost ili psihofizički integritet članova svoje porodice. Zato bi nasilniku trebalo izreći i mjeru zabrane približavanja žrtvi, i to sve do izricanja presude, ali i mjere psihosocijalnog tretmana, te, zavisno od okolnosti slučaja, liječenja od zavisnosti poput alkohola, droga i sl.
In this paper, we strive to point out the special protection of children with developmental disabilities and invalids as victims of crime and violence, in accordance with international and national law. Through the analysis of the judgment of the European Court against Bosnia and Herzegovina, we want to point out the secondary victimization of such persons who have been mistreated by civil servants and responsible for the state of Bosnia and Herzegovina. In the law on civil servants, it is necessary to incorporate responsibility for the execution of secondary victims of victimization in a manner that is personally liable for these violations of citizens' rights and that the damages caused are borne by themselves and that they are removed from the civil service.
Victims and witnesses may be reluctant to give information and evidence because of perceived or actual intimidation or threats against themselves or members of their family. This concern may be exacerbated where people who come into contact with the criminal justice system are particularly vulnerable. For instance, by virtue of their age and developing levels of maturity, children require that special measures be taken to ensure that they are appropriately assisted and protected by criminal justice processes.Victims who receive appropriate and adequate care and support are more likely to cooperate with the criminal justice system in bringing perpetrators of crime to justice. However, inadequacies of criminal justice systems may mean that victims are not able to access the services they need and may even be re-victimized by the criminal justice system itself.
