ÖZUluslararası hukuk tarafından düzenlenen alanlar arttıkça uluslararası hukukun parçalanması (fragmentation) bir gereklilik olarak ortaya çık-maktadır. Birbirine ters düşen çıkarların ve konuların uluslararası hukuk tarafından düzenlenmesi ancak bu şekilde mümkün olabilmektedir. Bu çerçevede genel uluslararası hukuk düzenlemelerinden kaçış yerine belli alanlarda bölgesel düzenlemelere yönelişten söz edilmektedir. Bu durum BM örgütünün ve kurumsal yapısının değişimi tartışmalarını gündeme getirmektedir.Makale uluslararası hukukun bütünleştirilesi ve parçalanması arasın-daki gerilime ve yeni gelişimlere ışık tutmak amacıyla hazırlanmıştır.Anahtar Kelimeler: Uluslararası hukukun bilateral karakteri, Badinter Komisyonu, Avrupa İnsan Hakları ve Özgürlükleri Sözleşmesinin anayasa karakteri, zorunlu yargı, erga omnes yükümlülük, fragmentasyon. ABSTRACTFragmentation of international law appears in case of necessity as long as increase of areas that coordinated by international law. Coordination of contradictorily interests and areas by international law enables only by this way. In this framework, orientation to regional arrangements in particular areas is mentioned instead of escape from general legal arrangements. This situation leads to discussions on reformations in UN organization and UN organizational structures as a current issue.This article aims to set light on tension between integration and fragmentation of international law and recent developments.
