Negara hukum di Indonesia sering disebut dengan rechtstaats atau the rule of law. Indonesia dalah ngara hukum dicantumkan dalam Pasal 1 ayat (3) UUD 1945. Bahwa elemen dari demokrasi adalah adanya kebebasan HAM, bahwa setiap warga negara menikmati hak-hak dasar, dalam demokrasi setiap warga masyarakat dapat menikmati hak-hak dasarnya secara bebas. Perkembangan negara hukum demokrasi ditinjau dari aspek penegakan hukum administrasi lingkungan hidup di indonesi adalah dapat ditinjau melalui Teori negara organis dan Teori negara pluralis. Berdasarkan teori negara organis jika melihat dari aspek penegakan hukum administrasi lingkungan hidup di Indonesia negara telah mengatur mengenai penegakan sanksi administrasi lingkungan hidup dimana agar negara dapat mengatur mengenai setiap kegiatan dan/atau usaha dibidang lingkungan hidup. Dilihat dari teori negara pluralis Ditinjau dari teori negara pluralalis ini negara mengakomodasi berbagai kepentingan yang majemuk dalam masyarakat. Bahwa negara telah mengakomodir seluruh hak setiap warga negara atas lingkungan hidup yang baik dan sehat melalui kebijakan-kebijakan pemerintah yang pro lingkungan.
Indonesia, Indonesia is a nation of law that uses a rule of law country (rechtstaat) concept. The concept of rule of law Indonesia set forth in its Constitution, the 1945 Constitution, Article 1 paragraph (3). There is an important element of democracy stated on the Constitution, namely the protection of human rights, that every citizen has the right to enjoy it. One of the rights protected in the Constitution is right to access a good and healthy living environment. For this, the environment needs to be preserved and function through administrative law enforcement. The study uses normative juridical approach with descriptive-analytics, which describes the norms and associated with theories, and opinions of legal experts. The development of a democratic nations of law can be seen from the aspect of law enforcement in particular with environmental administration. In Indonesia, it can be reviewed through the theory of organic states and the theory of pluralist states. Based on the theory of an organic state and looking at the aspects of environmental administration law enforcement in Indonesia, the state has regulated the enforcement of environmental administrative sanctions whereby the state can regulate every activity and/or business in the environmental issues. Therefore, the pluralist state theory recognized a variety of diverse interests in society that the state has accommodated all citizens rights to a good and healthy environment through pro-environment government policies.
One marine pollution source is oil discharge from vessel activity, then spread by the current and the wind. Such as the pollution of the North Coast of Bintan Island adjacent to the Singapore Strait caused by sludge oil which has occurred for years. This pollution has an impact on the sustainability of marine resources and tourism in the area. The countermeasure by the local government is to collect sludge oil using nets. This paper is the result of research on the solution strategy. The research methodology uses Doctrinal legal research with statutory, conceptual, and case approaches. Based on research results the solution strategy for sustainability to marine is to apply the principle of cooperation for user states and littoral states of the Singapore Strait by the treaty because the case is not easy to prove causality through scientific verification, the solution that can be done is by applying the principle of cooperation with bilateral or multilateral cooperation agreements between the littoral state and the user state in the Singapore Strait. That way most effective in resolution and avoiding conflict.
