Dusun Dalam Village Government established a Village-Owned Enterprise (BUMDes) Karya Dermawan is a policy utilization. The main pillar was established BUMDes Karya Dermawan in accordance with the mandate of the objectives whose activities were oriented to encourage the welfare of the village community. Therefore, this study was conducted aimed at looking at the welfare provided by BUMDes Karya Dermawan Dusun Dalam village especially to the beneficiary community and compare the level of welfare before and after BUMDes Karya Dermawan was established. This study uses a descriptive quantitative approach, and data sourced from primary data by using Paired Sample t-Test as a data analysis tool. This study shows that BUMDes Karya Dermawan provides welfare to the beneficiary communities through businesses that have been established including Cooperatives; Alsintan; and Workshop, which is directly able to change or succeed in providing an increase in welfare for the beneficiary community after the establishment of BUMDes as evidenced by the results of the Paried Sample t-Test analysis. With this evidence of success, for all elements should give intensive attention; so that the development of BUMDes Karya Dermawan exists even more as a driver of community welfare. And also, integratedly invites and becomes a valuable lesson for existing villages to establish BUMDes or villages that already have BUMDes, but have not succeeded in providing a common thread for the welfare of their citizens.
Maqasid sharia is still one of the exciting study themes to be studied. Because of its development, the study of maqasid discourse is still in an effort to find the ideal form of the conceptual formulation. For this reason, this study will review the correlation between the understanding of maqasid sharia and social change as a necessity in an effort to do istinbath al-ahkam. This article uses a qualitative research method that uses authoritative references as primary sources and scientific publications as secondary sources of references which are then analyzed using descriptive-analytical methods. Three main points can be concluded from this article, namely: 1) the development of thought and social change influences the istinbath al-ahkam method of cases that are waqi’iyah; 2) understanding of social changes in society based on socio-anthropological aspects both in the Nubuwwah era and today is significant in maqasidi reasoning; 3) understanding maqashid sharia and social change is very urgent (essential) for a jurist, especially for the purposes of istinbath al-ahkam so that the legal conclusions drawn do not depend on a literal understanding of the text alone; Moreover, this legal case never happened in the time of the Prophet Muhammad p.b.u.h. is still alive, and it is difficult to find the text explicitly, and the resulting law can carry the spirit of the maqasid itself, namely masalih lil ‘ibad.Keywords: Maqashid Sharia; Social Change; Istinbath al-Ahkam.Abstrak: Maqasid al-syari’ah menjadi salah satu tema kajian yang menarik untuk dikaji. Sebab dalam perkembangannya, kajian diskursus maqasid masih dalam upaya mencari bentuk rumusan konsepsi yang ideal. Untuk itu, kajian ini akan mengulas korelasi antara pemahaman atas maqasid al-syari’ah dan perubahan sosial sebagai sebuah keharusan dalam upaya melakukan istinbath al-ahkam. Artikel ini menggunakan metode penelitian kualitatif yang menjadikan rujukan-rujukan otoritatif sebagai sumber primer dan publikasi-publikasi ilmiah sebagai sumber sekunder referensinya yang kemudian dianalisa dengan metode deskriptif-analitis. Ada tiga poin utama yang dapat menjadi kesimpulan artikel ini yaitu: 1) perkembangan pemikiran dan perubahan sosial mempunyai pengaruh terhadap cara istinbath al-ahkam atas kasus-kasus yang bersifat waqi’iyah; 2) pemahaman atas perubahan sosial masyarakat yang berbasis pada aspek sosio-antropologis baik pada masyarakat era nubuwwah maupun saat ini sangat penting dalam nalar maqasidi; 3) memahami maqashid al-syari’ah dan perubahan sosial menjadi sesuatu yang sangat urgen (penting) bagi seorang ulama ahli hukum terutama bagi keperluan istinbath al-ahkam sehingga kesimpulan hukum yang diambil tidak bergantung pada pemahaman nash secara literal semata; apalagi kasus hukum tersebut tidak pernah terjadi di zaman Rasulullah masih hidup, dan sulit dicari nash-nya secara eksplisit, serta hukum yang dihasilkan dapat membawa ruh dari maqasid itu sendiri yaitu masalih lil ‘ibad.Kata Kunci: Maqashid al- Syari’ah; Perubahan Sosial; Istinbath al-Ahkam.
Two calendar systems are developing globally, namely the Syamsiyah system (solar system) and the Kamariah system (lunar system). The lunar system is a calendar used by Muslims and has utility in worship rituals based on the calendar period. Qur’an and Hadith have mentioned this completely, namely, one year consists of twelve months. This study aims to determine the determination of the beginning of the lunar month using the rukyat method and to determine the extent to which the implementation of the rukyat method can be accepted by the Indonesian people. The type of research in this article is qualitative research or also known as naturalistic research methods. The data analysis techniques used were condensation, data presentation, and drawing conclusions. The results of the study show that the rukyat method is one of the methods of determining the lunar month, which has been carried out since the time of the Prophet Muhammad p.b.u.h. and his companions, even today it is still used by Muslims around the world, including in Indonesia. Rukyat is a method of determining the beginning of the lunar month by paying attention to important matters and conditions. As for the obstacles of the sighting as determining the beginning of the lunar month, there are several factors, namely the eye of the observer, the shape of the new moon, weather, seeing, the height of the new moon, the distance of the bow and the observer’s psychology
Nahdlatul Ulama memiliki gerbang besar atau dasar fundamental yang sangat kuat untuk melakukan transformasi pemikiran fiqh. Permasalahan pokok dalam penelitian ini dapat dirumuskan sebagai berikut: 1) bagaimana transformasi pemikiran fiqhdi Lembaga Bahts al-Masâ`il Nahdlatul Ulama terutama dalam hal metode istinbâth ?; b) bagaimana transformasi dalam hal orientasi rujukan madzhab, dan diversifikasi referensial, serta respon terhadap diskurusus talfiq?; dan c) sebagai Lembaga Bahtsul Masail Diniyyah, bagaimana cakupan dan luas lingkup kajian LBMNU ?. Penelitian ini termasuk jenis penelitian kepustakaan (library research) dengan menggunakan teknik data content analysis (analisis isi).Hasil penelitian antara lain sebagai berikut: 1) dalam bidang istimbath, ada pergeseran sistem dari qauliy (termasuk ilhaqy) ke sistem manhajiy; pemikiran fiqh yang formalistik ‘amaliy syakhshiy ke pemikiran fiqh jama’aiy; dari format pemikiran fiqh statis ke format pemikiran fiqh yang dinamis; 2) adanya kesediaan membuka diri membolehkan talfiq secara proporsional dan sesuai situasi dan kondisi; 3) dalam bidang diversifikasi referensial, ada dinamika dan perluasan referensi di kalangan NU. Sedangkan dalam bidang materi bahasan, telah meluas pada bidang-bidang yang menyangkut kemaslahatan rakyat atau masyarakat luas.
The Ottoman Empire stood above Sharia’s Islam, which at first was only a sultanate and then its power expanded to the gates of Vienna (Austria), the North African region, Arabia and its territory to Aceh Darussalam. The Legal Capitulation Treaty was favorable in the heyday, because traders were stimulated to carry out activities in the Ottoman ports, especially in Istanbul. Significant increase in the country's foreign exchange, so that large activities are carried out without any monetary shock. After a leadership crisis, this legal capitulation agreement has been fruitful. More and more foreign consuls, expanded treaties and sharia judgments began to lose function because many Christian citizens and Jews who had never known the French, British and other European countries had taken refuge behind the Capitulation agreement which had privileges in tax relief, immune from civil or criminal law. This led to the secularism of Ottoman law which contained European law material. There is an uncontrolled Tanzimat, it should only be in the field of military and economic technology and strategy but has penetrated the judicial system and legal material. Which ends with the loss of Ottoman sovereignty.
