"transferu" Niemców sudeckich The political philosophy of Edvard Benes and its impact on the legal regulations of the resettlement of the Sudeten Germans P ostać czeskiego polityka-posła, wieloletniego ministra spraw zagranicznych, prezydenta-budzi gorące spory zarówno w jego ojczyźnie, jak też poza jej granicami. 1 W swoim artykule postaram się dokonać rekonstrukcji i analizy poglądów czeskiego męża stanu. Główną tezą, jaka będzie mi towarzyszyła, jest przekonanie (którego będę dowodzić), że działania zarówno na forum polityki międzynarodowej, jak i wewnętrznej, podejmowane na przestrzeni 40 lat miały korzenie w wyznawanej ideologii. Fakt wpływu indywidualnych przekonań polityków na ich działalność w pierwszym oglądzie nosi wszelkie znamiona banału. Jednak wydaje mi się, że w przypadku osoby Benesza owa konstatacja wcale nie jest tak oczywista jak mogłoby się wydawać. Zauważmy, że w literaturze przedmiotu zasadniczo nie 1 Kontrowersje dotyczą różnych płaszczyzn działalności Benesza i w zależności od autora rysują bardzo różny, pełen sprzeczności obraz czeskiego polityka. Dla przykładu, autorzy czescy często akcentują dwuznaczność reakcji na układ monachijski czy poparcia po wojnie reżimu komunistycznego (wątek ten jest również silnie obecny w literaturze polskiej), zaś Słowacy wysuwają oskarżenia o próbę czechizacji ich narodu.
A just war, not a holy war: medieval concepts of armed conflictThe aim of the article is to point out that medieval thinkers, when referring to holy wars or just righteous wars, did not seek to justify armed conflicts. The authors hereof claim that the activities of philosophers of the Middle Ages were aimed at restricting armed conflicts and focused on making the hostilities more humanitarian. Therefore, a “just war” was a war guarded by a number of preconditions which constituted a mandatory condition. The idea of a just war was rooted in the biblical tradition mainly in the New Testament and in the ancient legal thought. The medieval concept of war affected, among other things, the formation of the knight’s ethos and habits of war.

To sprawia, że analiza owej idei jest poznawczo istotna i nie można jej lekceważyć. Wolność jest jednym z podstawowych praw gwarantowanych przez współczesny konstytucjonalizm. Artykuł jest analizą filozoficznoprawnego rozumienia pojęcia wolność i sposobów przenoszenia go na grunt prawa. Autor stawia tezę, że pojęcie wolności jest dla europejskiego prawnika pojęciem nieostrym, na fundamencie którego trudno zbudować system prawny. Z jednej strony pojęcie to wydaje się oswojone i trudno je bezpośrednio zanegować, ale jego zdefiniowanie a tym bardziej przyjęcie konsekwencji jakie się z ową definicją wiążą jest dyskusyjne.
<p>The article analyzes the process of displacing law and its values from political thinking. There are many indications that law and its values are not a point of reference for contemporary politics, which results from the ongoing process of democratization. The coherence of virtues, law and politics, variously approached and variable over time, lasted in European culture for more than a thousand years. The Greek models have been adopted and consolidated by the Romans and Medieval thinkers. The breakthrough is brought by Machiavelli’s writings, which radically changed the view of politics, free will, power. The nature of the state ceases to mean providing citizens with a happy life, and it begins to concern security. As a result, law becomes a tool to protect this security effectively.</p>
