Resumo: O proibicionismo, a "guerra às drogas" e a criminalização da pobreza são elementos situados no âmbito político e ideológico, se materializam na luta de classes e são utilizados para o controle social. Mostramos a partir de alguns trechos de sentenças judiciais e manifestação do Ministério Público, o quanto os discursos ideologizados justificam a criminalização de adolescentes pobres por tráfico de drogas, colocando-os como inimigos sociais sem considerar as contradições e riscos que são submetidos cotidianamente.Palavras-chave: Proibicionismo. Abstract:The prohibitionism, the "war against drugs" and the criminalization of poverty are elements in the political and ideological context, they have materialized themselves in the class struggle and they are used for social control. From excerpts taken from court decisions and manifestations of the Department of Justice, we show how much the ideologized discourses justify the criminalization of poor adolescents for drug traffic and place them as social enemies. Such discourses do not consider the contradictions and risks to which such adolescents are submitted daily.Keywords: Prohibitionism. Adolescents. Drug traffic. Criminalization of poverty. ECA. Relações de trabalho no narcotráfico: exploração, riscos e criminalização Labor relations in drug trafficking: exploration, risks and criminalizationAndréa Pires ROCHA 1 Resumo: O presente artigo discute as relações de trabalho na produção, distribuição e circulação da drogamercadoria. Partimos de reflexões teóricas e empíricas desenvolvidas em tese de doutoramento (ROCHA, 2012), que pesquisou as trajetórias de adolescentes que são explorados como "mulas" do transporte de drogas proibidas na rota de tráfico da fronteira Brasil-Paraguai. Com base nesse estudo, temos por objetivo acirrar a discussão a respeito do negócio das drogas e da exploração da força de trabalho que recai sobre adolescentes, muitos deles, pertencentes ao grupo que Marx (1988) chamou de lumpemproletariado urbano, que, devido à condição de pobreza e vulnerabilidade, se submetem aos riscos do trabalho em troca de remuneração. Colocamos em discussão, os efeitos do proibicionismo como política ideológica de "guerra às drogas", que é utilizada como instrumento para criminalização de jovens pobres. Criminalização da pobreza.Abstract: This article discusses wok relations in the production, distribution and circulation of the drugcommodity. Our starting point is the theoretical and empirical reflections drawn upon a doctoral dissertation (ROCHA, 2012) in which the life trajectories of adolescents exploited as "mules" in the transportation of forbidden drugs in the traffic route of Brasil and Paraguai border were studied. Based on that research our objective is to increment the discussions on the use of the workforce of adolescents who are part of the group Marx (1988) called urban lumpenproletariat which, because of social and economic vulnerability, accept the risks of such a job for a certain income. Besides, we discuss the effects of prohibition as an ideological policy that are used as a tool for criminalizing poor young people in the war against drugs.
Resumo: Este artigo toma as políticas de drogas como mirante de análise sobre a racionalidade governamental que incrementa respostas autoritárias à crise do capital. Esta resposta em período de neoliberalismo e de neoconservadorismo é seletiva e requisita apreender dois componentes do racismo estrutural − o racismo institucional e o religioso que se atualizam na política de drogas. A destituição da Presidenta Dilma Rousseff indicou uma crise geral de autoridade que fortaleceu a ascensão neopentecostal na organização das massas populares no Brasil a favor de um projeto necroeconômico e necropolítico abertamente antidemocrático. Com autores críticos, recupera-se a disputa materializada com o uso da força punitiva do Estado e com a atuação fundamentalista de segmentos neopentecostais. Apontamos que no interior do Estado neoliberal de cunho penal, o conservadorismo, racismo e ódio de classe recrudescem mecanismos de controle justificado pela guerra às drogas, incidindo sobre os corpos e qualquer vestígio de vida de negros e pobres.
Resumo:O presente artigo apresenta os resultados da pesquisa desenvolvida para a conclusão do Curso de Especialização em Gestão de Centros de Socioeducação realizado no ano de 2010, na Universidade Estadual de Londrina. A investigação teve como objetivo conhecer os parâmetros utilizados pelos juízes para fundamentar a argumentação da aplicação da medida socioeducativa de internação de adolescentes que cometeram ato infracional. Para a realização desta análise, estabelecemos primeiramente um resgate histórico, político e legislativo referente à institucionalização de crianças e adolescentes no Brasil, mantendo um paralelo com acontecimentos mundiais relacionados ao tema, a partir de revisão bibliográfica sobre a temática. E, posteriormente, desenvolvemos uma pesquisa documental, tendo como fonte sentenças judiciais, das quais destacamos os argumentos apresentados pelos juízes e problematizamos os elementos identificados em nossa revisão bibliográfica. Assim, buscamos verificar se a lógica construída no Brasil de privar adolescentes de sua liberdade foi rompida após a instituição da doutrina da proteção integral ou mantém-se reproduzindo valores dos antigos "códigos de menores" que criminalizam a pobreza, os adolescentes e suas famílias.
