O presente artigo analisa a teoria da desconsideração da personalidade jurídica inversa, que com o advento do Código de Processo Civil de 2015, onde tem definida a forma como deve ser processada, podendo ser requerida na petição inicial ou incidentalmente no decorrer do processo em qualquer fase que este se encontre e, com isto, a sua aplicação acaba por ser projetada também no direito material, que até então, ocorria amparada pela jurisprudência à luz dos princípios gerais de direito. O seu manejo se dará da mesma forma que a desconsideração da personalidade jurídica propriamente dita prevista no artigo 50 do Código Civil de 2002. Tornando assim, a sanção pela má utilização da pessoa jurídica, mais efetiva e mais justa, pois resolve questões polêmicas, como o cerceamento da defesa do devedor, garantindo tanto o direito do credor em receber o que lhe é devido quanto a efetivação do devido processo legal para o devedor, o que vem de encontro à necessidade de se dar maior efetividade aos princípios constitucionais da autonomia patrimonial e da livre iniciativa, contribuindo para o amadurecimento do instituto da pessoa jurídica e inibindo a ação daqueles que pretendem utilizá-la de forma indevida.
