Los movimientos de la disidencia sexogenérica encarnan aquello que Carlos Monsiváis denominó una “geopolítica del relajo y el deseo” (Monsiváis 1998: 56). Su carácter rebelde, confrontativo, pero también gozoso y placentero, les han convertido en agentes clave para la crítica a los discursos hegemónicos sobre el género, el sexo y el deseo a lo largo y ancho de las ciudades, los barrios y las zonas rurales de nuestro continente. Estos movimientos, además, son el sitio de encuentro de una serie de apuestas teórico-conceptuales feministas y cuir necesarias para los procesos de nombramiento y reconocimiento de identidades y comunidades diversas, así como de nuevas posibilidades de ser/estar en el mundo.
En este artículo se revisa la historia del denominado feminismo marxista y se reconstruyen los principales momentos de su desarrollo histórico, así como sus debates teóricos centrales. Primero, se analiza el tratamiento de Marx y Engels sobre la denominada “cuestión femenina”, continuado por una breve revisión de los principales desencuentros y alianzas entre dos movimientos sociales: las asociaciones de mujeres y los movimientos obreros en Europa en el siglo XX. Posteriormente, se reconstruye la historia de los debates teóricos que se originaron en el seno del feminismo radical de los años setenta. En este apartado se analiza el debate sobre el trabajo productivo y reproductivo, seguido de la disputa sobre las fuentes de la opresión femenina; asimismo se discuten los términos de la relación entre dos categorías fundamentales a estas teorías: el género y la clase. Finalmente, se señalan los alcances de estos debates para las teorías contemporáneas sobre la justicia, en la formulación de Nancy Fraser. Se propone entender la historia y teoría feminista marxista como una ampliación del análisis económico del marxismo tradicional, con lo que se intenta mostrar la necesaria relación entre un feminismo anticapitalista y un marxismo feminista.
En este artículo se reconstruyen algunos antecedentes de la teoría del crimen y el castigo de la filosofía del derecho de Hegel la luz de la pregunta por el rol de la coerción en su justificación del castigo penal y su noción de derecho. Se muestra cómo la discusión normativa sobre el castigo y el crimen implica en su filosofía, la pregunta por la legitimidad del derecho penal para enforzar (to enforce) la ley por medio del castigo. Asimismo, se ubica el análisis de Hegel como parte de la reforma Ilustrada de la pena y se propone entender su teoría como una teoría mixta, en contraste con las teorías que afirman una lectura prioritariamente retributivista. El objetivo de este artículo es analizar el contexto teórico y los antecedentes históricos de su teoría del crimen y el castigo que cristalizan en los Fundamentos de la filosofía del Derecho de Berlín. Para concluir, se argumenta que la teoría de Hegel es una teoría mixta, es decir, que combina su carácter retributivo con funciones sociales adicionales, como la disuasión y la rehabilitación, y se rechaza la tesis que sostiene que la teoría más sustantiva del castigo de Hegel está contenida en el Derecho Abstracto. Asimismo, se muestra que la justificación completa de la legitimación de la pena (Strafe) sólo se alcanza en la dimensión de la Administración de la justicia en el apartado de la Sociedad Civil.
