Según diferentes análisis que han tenido lugar en los últimos años, en Ecuador, los animales deben ser considerados sujetos de derechos, estos son libres y deben ser tratados dignamente, pues son seres capaces de experimentar dolor y sufrimiento. De esta manera, surge la necesidad de analizar de qué manera los animales como seres vivos poseen el derecho a la libertad dentro de la legislación ecuatoriana. En el presente estudio descriptivo de tipo revisión documental se utilizaron los métodos exegético y hermenéutico, así como la técnica de análisis de contenido. Entre los principales hallazgos se tienen que: La Sentencia No. 253-20-JH/22 de la Corte Constitucional del Ecuador es un presente del reconocimiento de los derechos de los animales, lo cual, debe tomarse en cuenta, para incorporarse en el ordenamiento jurídico y reforzar las sanciones. Entre los aportes que realiza a la doctrina están los principios de interespescie y de interpretación ecológica que ayudan a comprender que, los animales tienen diferentes cualidades, que deben ser atendidas y de esa manera garantizar su integridad física, para responder al equilibrio del ecosistema. En el ordenamiento jurídico ecuatoriano se deben implementar medidas de protección y libertad, para generar el buen trato a los animales, y lograr así que se les cuide y considere como sujetos de derechos.
La ejecución del presente trabajo de investigación versa sobre la prestación de alimentos y la relación con la responsabilidad civil del obligado en el ordenamiento jurídico ecuatoriano. La metodología emplead se basó en el método inductivo, de enfoque cualitativo, de tipo analítico jurídico, diseño no experimental, empleando la hermenéutica jurídica como la técnica de interpretación de leyes, doctrinas y jurisprudencia para obtener los resultados. Los principales hallazgos demostraron que existe una responsabilidad civil derivada del incumplimiento del alimentante que acarrea como consecuencia la prohibición de salida del país, pero también medidas más gravosas como el apremio personal, el cual puede ser total o parcial. Las referidas medidas son aplicables únicamente a los obligados principales de la obligación de prestación de alimentos, por lo que no pueden ser invocadas como instrumentos coercitivos para los obligados subsidiarios, quienes tendrán responsabilidad civil pecuniaria, de tal manera que pueda asegurarse el cumplimiento de la obligación y la satisfacción de necesidades de los niños, niñas y adolescentes.
El presente artículo tiene por objetivo analizar la responsabilidad del Estado ecuatoriano respecto al derecho de repetición, cuando existe dolo o culpa grave provocado por sus servidores públicos a un particular, para lo cual se desarrolló un estudio descriptivo con enfoque cualitativo, sustentada en los métodos exegético, revisión documental y revisión bibliográfica, así como en la técnica de análisis de contenido. Entre los principales hallazgos se encuentran la responsabilidad del Estado por las acciones y omisiones de sus servidores públicos en el ejercicio de sus funciones, correspondiéndole la reparación del daño provocado a los particulares violentados, siempre y cuando, esto sea dispuesto en sentencia por la autoridad competente. La responsabilidad que adquiere el Estado se tipifica en civil, administrativa y penal. El derecho de repetición surge cuando el daño que se ha reparado es imputable a hechos, actos u omisiones de los servidores públicos en el desempeño de sus cargos; este puede ser aplicado para recuperar la pérdida económica ocasionada al Estado. Entre las reparaciones posibles están la patrimonial, la no patrimonial y las integrales.
