Öffentlichkeitsbeteiligung ist ein zentrales Thema in der demokratisch verfassten Gesellschaft, insbesondere wenn es um zukunftsweisende Entscheidungen geht wie etwa beim Einsatz neuer Technologien. In der Technikbewertung sind in den vergangenen Jahren verschiedene Verfahren der Öffentlichkeitsbeteiligung entwickelt und erprobt worden. An sie werden nicht nur seitens der Politik hohe Erwartungen hinsichtlich ihrer problemlösenden und sozialintegrativen Funktion gestellt. In dem vorliegenden Band sind diese Verfahren erstmals Gegenstand einer einführenden Übersichtsdarstellung. Dabei wird die Leistungsfähigkeit dieser Verfahren aus demokratietheoretischer Perspektive untersucht. Ferner werden die Möglichkeiten ihrer Anbindung an die politisch-rechtlichen Institutionen der repräsentativen Demokratie diskutiert. Damit spricht der Band alle diejenigen an, die sich in theoretischer und praktischer Hinsicht für das komplexe Verhältnis von Technik, Demokratie und Öffentlichkeit interessieren.
In a comparative study in seven European countries, the impact of participatory decisionmaking procedures on the communicative construction of citizenship was studied. Oral and written data from licensing procedures on genetically modified organisms (GMOs) have been analysed with methods of conversation analysis. The study shows that participatory science governance itself may cause serious trouble when it is embedded in a formal procedure with a relatively strong legal framework. Political communication becomes rather marginal under such circumstances. This result indicates that the unspecific claim for more and broader participation of the public might be dysfunctional, even if it seems to be legitimate from a normative point of view.
Participation of a broad variety of actors in decision-making processes has become an important issue in science and technology policy. Many authors claim the involvement of stakeholders and of the general public to be a core condition for legitimate and sustainable decision making. In the last decades, a wide spectrum of procedures has been developed to realize biotechnological citizenship. These procedures, composed of multiactor arenas, are either located in close relation to the system of politics, or, as in the case of administrative decision making, more closely to the system of law. In the latter case, a problematic constellation arises. Here, law and science can build a technoscientific normativity that systematically excludes political discourse. The law, although intending to provide for political freedom and citizenship rights, at the end appears to be an ''iron cage'' for political communication.
ZusammenfassungAm Beispiel des Gentechnikrechts wird dargelegt, daß Partizipationssemantiken im Rechtssystem auch eine Konsequenz ausbleibender Programmierungsleistungen durch die Politik darstellen. Insbesondere kann Öffentlichkeitsbeteiligung als Kompensation für die fehlschlagende Externalisierung von Entscheidungsrisiken verstanden werden. Gleichzeitig treten aber Irritationen im Recht auf, die aus einer durch die Partizipation bewirkten Entdifferenzierung der Teilsysteme resultieren. Wir beobachten nun einen Trend zur Re-Differenzierung und „Schließung“ des Rechtsdiskurses. Da das Rechtssystem jedoch auch weiterhin auf Programmierungsleistungen aus anderen Bereichen angewiesen bleibt, erscheint es angesichts der empirischen Schwierigkeiten mit den bisherigen Formen der Öffentlichkeitsbeteiligung ratsam, die „Schnittstellen“ des Rechts zu Wissenschaft und Politik in Sonderformen wie „Runden Tischen“ und Technikfolgenabschätzungen zu untersuchen.
