Este artigo, visa analisar o formato e a atuação dos provedores de aplicações, em especial buscadores e redes sociais, e como procuram justificar ações editoriais sobre o conteúdo de terceiros que circula em suas redes. Examinaremos brevemente a história jurídica que permitiu que os intermediários atuassem dessa forma. Por fim, analisaremos algumas possíveis soluções para o problema, tanto no âmbito norte-americano como no brasileiro. Conclui-se não haver, prime facie, ilegalidade na ação moderadora dos novos intermediários. Há liberdade de negócio e livre iniciativa das empresas. Mas isso não implica a necessidade de vácuo jurídico de normas que regulem os limites da atividade editorial desses intermediários. Principalmente quando se trata de plataformas que dominam amplamente o mercado em sua área de atuação.
Este artigo visa analisar se as tecnologias que empregam geolocalização no combate à COVID-19 estão adequadas à Lei Geral de Proteção de Dados Pessoais – LGPD. Primeiro, estudaremos como a jurisprudência norte-americana tem decidido em questões de geolocalização e privacidade. Em seguida, examinaremos algumas inciativas e tecnologias de geolocalização no âmbito da COVID-19 utilizadas por diversos países, como a triangulação, o Cell-Site Location Information – CSLI, o GPS e o Bluetooth. Depois, analisaremos como a legislação europeia tem lidado com o assunto e, por fim, verificaremos a adequação das mencionadas inciativas e tecnologias de geolocalização no âmbito do combate à COVID-19 em relação à LGPD. O artigo utiliza o método comparativo, averiguando o tratamento dispensado ao tema em outros países, bem como uma abordagem dedutiva, levando em conta a pesquisa bibliográfica e a análise de situações particulares.
Purpose – The purpose of this article is to investigate whether the reversal to the public domain of assets owned by the current service provider, in the context of concession of public telecommunications service, is still the only, or even better, way to achieve the objectives it aims, especially the continuity of the service, in relation to the theoretical framework of Ayres and Braithwaite’s Theory of Responsive Regulation. Methodology/approach/design – The research will consider the structuring statutes of the telecommunications sector, the secondary norms produced by Anatel, as well as national and foreign literature on the subject. Findings – After analyzing the doctrinal and normative framework on the subject of reversible assets in the telecommunications sector in light of the Responsive Theory of Regulation, it is believed that it will be possible to discern solutions that best fit the analyzed Theory, and there are many arguments against the preservation of the current model, which does not incorporate adequate regulatory modeling to address the issue.
