Este artigo objetiva discutir alguns aspectos relativos à audiência de conciliação e mediação no processo civil brasileiro, em razão do crescente estímulo à solução consensual de conflitos, verificado pelo movimento de reformas processuais pós-1988. Tomando-se como marco o processualismo constitucional democrático, necessário se faz enfatizar as premissas básicas para se compreender adequadamente o uso da mediação e da conciliação como técnica de solução consensual de conflitos, para evitar que o furor neoliberal de alta produtividade desvirtue o seu propósito constitucional. Também é importante ressaltar as particularidades procedimentais da audiência de conciliação e mediação nos procedimentos comum e especiais, devido ao fato de o sistema processual brasileiro possuir muitas variações.
O artigo objetiva discutir as recentes propostas de alterações legislativas sobre processo coletivo: projetos de lei nº 4.441/2020 e nº 4.778/2020. Especificamente, o tema do estímulo às soluções consensuais dos conflitos. A abordagem se faz necessária devido ao fato de que o movimento de promoção das ADRs [Alternative Dispute Resolution] não pode ser ingênuo e romanticamente compreendido. Assim, o artigo propõe contextualizar o incentivo de uso de ADRs aos avanços da política neoliberal de Estado, bem como enfatizar a importância que as audiências públicas podem adquirir no processo de formação das deliberações públicas de autocomposição de litígio coletivo.
O artigo objetiva discutir três importantes questões trazidas pelo CPC/2015 sobre a técnica de apresentar contrarrazões, cuja compreensão dependem de profunda análise sistemática da legislação processual. Indispensável, para tanto, tomar como marco teórico a compreensão de processo constitucional como metodologia garantidora de Direitos Fundamentais e a proposta processual da comparticipação normativa entre os sujeitos processuais, principalmente no que diz respeito ao alerta que faz acerca da alta complexidade do sistema processual brasileiro. Serão destacadas que as contrarrazões se constituem, a partir da vigência do CPC/2015, em meio técnico para impugnar decisão interlocutória não agravável, pleitear a majoração de honorários sucumbenciais e discutir a aplicação ou não de precedentes judiciais. Assim, a expectativa é que o texto desperte maior atenção aos estudiosos do Direito Processual no que diz respeito à técnica de apresentar contrarrazões aos recursos.
O artigo tem como objetivo demonstrar que a réplica pode ser melhor explorada tecnicamente na prática jurídica, a partir de uma compreensão dinâmica e sistematicamente abrangente do processo civil. Isso permitirá que as lentes da réplica sejam ampliadas para visualizar suas oportunidades técnicas para além de apenas manifestar sobre as preliminares ao mérito e sobre o conteúdo da defesa indireta arguidas na contestação pelo réu. Ao final, espera-se que o texto seja capaz de alertar a comunidade jurídica sobre a importância da réplica para fomentar a participação dos sujeitos processuais na construção das decisões judiciais.
