Entre os anos de 1973 e 1990, o Chile foi governado por um regime militar ditatorial, comandado por Augusto Pinochet. Durante o regime foram editados inúmeros Decretos-Lei e foi promulgada a Constituição de 1980, a qual passou por importantes reformas em 2005. Dentre os Decretos-Lei editados, encontra-se o Código Tributário de 1974, o qual prevê em seu artigo 116 a possibilidade de delegação de competência jurisdicional de casos tributários. O artigo pretende analisar a posição do Tribunal Constitucional em três casos em que se questiona a constitucionalidade do referido artigo 116 do Código Tributário e, a partir dos julgados, busca analisar o nível de suficiência/eficiência do sistema de controle constitucional chileno. Para tanto, utilizou-se de delineamento de pesquisa na forma de estudos de casos, os quais foram analisados à luz do método de abordagem da sociologia histórica. Concluiu-se que o sistema de controle de constitucionalidade chileno possui características que o tornam “engessado” e com reduzida eficiência para lidar com o desafio do legado legislativo do regime Pinochet.
