Os pressupostos cosmopolitas introduzidos por Kant na obra “À Paz Perpétua” inspiraram a Convenção de Genebra sobre o Estatuto dos Refugiados de 1951, estando na base do princípio do non refoulement, segundo o qual um refugiado não pode ser enviado de volta ao país de origem se isso representar risco para a sua vida. Mas o princípio do non refoulement, em si, não garante direitos e nem pertencimento no novo país, fato constatado por Hannah Arendt ao reconhecer o “direito a ter direitos” no país de acolhimento. Para efetivação desses direitos, entretanto, Benhabib afirma ser necessária uma reconfiguração do conceito de soberania e do papel do Estado-Nação.Objetivo: O artigo procura analisar a evolução do pensamento cosmopolita em Kant, Arendt e Benhabib e suas contribuições para a compreensão da temática da proteção internacional dos refugiados.Metodologia: A pesquisa adota uma abordagem indutiva e utiliza a técnica de pesquisa bibliográfica e de análise de casos com objetivos exploratório e propositivo.Resultados esperados: Identificar os óbices que impedem a efetivação dos direitos humanos e do pertencimento de refugiados nos países de acolhimento.Conclusões: Conclui-se que, se por um lado, os motivos encontram-se na necessidade de um novo equilíbrio no binômio soberania-direitos humanos, por outro lado, a visão popular sobre o estrangeiro não mudou muito desde o período descrito por Arendt em sua obra Origens do Totalitarismo, permanecendo o medo, a xenofobia e o racismo como importantes óbices ao direito de pertencimento.
O presente trabalho de conclusão busca tratar especificamente, de toda a história responsável pela criação do Tribunal Penal Internacional, bem como sua estrutura, seus princípios basilares e crimes de sua competência, conforme o Estatuto de Roma. O Tribunal Penal Internacional teve criação a partir de um compilado dos Tribunais Militares criados em situações de extrema barbárie humana, como em Nuremberg (1945), no Extremo Oriente (1946), a Antiga Jugoslávia/Iugoslávia (1993) e Ruanda (1994). Nascendo da extrema necessidade de uma justiça imparcial para julgar, de forma complementar, os quatro crimes previstos no Estatuto de Roma, evitando, assim, a impunidade de pessoas que cometam graves crimes contra a humanidade. Possui função de evitar porto seguro a criminosos poderosos que são capazes de intimidar autoridades judiciais nos seus Estados de origem, fazendo com que os graves crimes não sejam levados à justiça ou terminem sendo absolvidos em contradição às provas produzidas. O Estatuto de Roma possui estrutura, princípios, competências e penas específicas, sendo uma coligação dos sistemas jurídicos das maiores potências. Interessa identificar o funcionamento e as competências deste tribunal para analisar a aplicabilidade em casos práticos como o de Jair Messias Bolsonaro e Vladimir Putin.
O presente artigo tem por objetivo verificar o estado do conhecimento envolvendo temas relacionados ao direito feminino em âmbito internacional. Trata-se de uma revisão bibliográfica de artigos, teses, livros, documentos internacionais e decisões que visam a proteção aos direitos básicos da mulher, a qual visa demonstrar o impacto das crises humanitárias em direitos conquistados pelas mulheres e como a evolução desses direitos seguiu de maneira divergente em nações do ocidente e do oriente, uma vez que ainda há a luta por acesso de mulheres à educação, mercado de trabalho e saúde básica em meio ao século XXI, pois há dificuldade de aplicação dos tratados internacionais em diferentes Estados por questões políticas e culturais. Portanto, entende-se necessária a revisão e/ou complementação das convenções internacionais, especialmente a Convenção sobre a Eliminação de Todas as Formas de Discriminação Contra Mulher (CEDAW), pois os direitos femininos tendem a ser questionados em períodos de crise, demonstrando que embora legitimamente conquistados, não são garantidos.
