O presente artigo objetiva discorrer sobre as mudanças sociais relacionadas à família, verificando o surgimento do conflito na ausência de diálogo na família. Examinar a importância da mediação na melhoria do diálogo no fim do relacionamento conjugal, já que a ruptura na relação familiar ocasiona o sofrimento em todos os envolvidos no litígio. Contextualizar o aumento da demanda judicial com o problema do acesso à justiça. Apresentar a experiência pioneira das oficinas de parentalidade, que utilizam técnicas da mediação de conflitos, para auxiliar no diálogo em divórcios conturbados, baseando o estudo em pesquisa de campo, bibliografia e dados governamentais.
Nas últimas décadas, organizações internacionais, entes estatais, organizações não governamentais e a sociedade como um todo, lançou seu olhar para a luta travada pelos deficientes, almejando sua inclusão social. Uma série de documentos internacionais foram criados, visando não só melhorar as condições de vida do deficiente, mas colocar em pauta inclusão social. Cada ser humano tem o direito de desfrutar de todas as condições necessárias para o desenvolvimento de seus talentos e aspirações. O deficiente deve ter ao seu dispor condições especiais, além da proteção garantida a todos, que minimizem ou eliminem as barreiras para a sua vida em sociedade. A Convenção sobre os Direitos das Pessoas com Deficiência, ratificada pelo Brasil, teve como propósito maior promover, proteger e assegurar o pleno exercício dos direitos humanos das pessoas com deficiência, demandando dos Estados-partes medidas legislativas e administrativas. No âmbito legislativo brasileiro, após várias normas tratando do assunto, foi instituída a Lei Brasileira de Inclusão da Pessoa com Deficiência (Estatuto da Pessoa com Deficiência). Certamente, apesar de sua importância, a legislação não tem o poder de transformar rapidamente o comportamento da sociedade. São necessárias políticas públicas, já previstas no próprio Estatuto, para estimular e acompanhar esse processo. A inclusão do deficiente no mundo do trabalho é uma das mais importantes vertentes desse esforço. Através dos números obtidos pelos sistemas de estatística existentes é possível: analisar o grau de sucesso, verificar onde as políticas públicas de inclusão apresentam falhas e sugerir mudanças.
O presente trabalho tem por objetivo relatar e analisar as a��es de responsabilidade social na inclus�o de deficientes no mercado de trabalho. A metodologia utilizada para este estudo foi o m�todo explorat�rio, com base em pesquisas bibliogr�ficas, somadas � pesquisa de campo. Foi utilizado como instrumento de pesquisa um question�rio, com os colaboradores portadores de defici�ncia f�sica, que participam ativamente do mercado de trabalho. O artigo promove uma reflex�o fundamental sobre as novas l�gicas de atua��o das empresas privadas em meio �s aus�ncias e lacunas do Estado democr�tico na inclus�o de deficientes. Constata-se que n�o existem a��es s�lidas de responsabilidade social para com os colaboradores deficientes, por n�o serem contemplados com os cuidados e direitos necess�rios e previstos na Legisla��o.
As lacunas possibilitam o Judiciário a interpretação e a discricionariedade quando da elaboração de decisões. Nem sempre há consenso quanto aos casos apresentados. Julgadores podem discordar entre si, porém isto não se dá quanto ao direito, mas com relação aos aspectos subjetivos. A discricionariedade dá margem de atuação aos tribunais. O Supremo Tribunal Federal vem sendo alvo de críticas por proferir decisões que as comunidades acadêmica e jurídica entendem como políticas. É o que será tratado no presente trabalho ao se analisar a postura adotada pelo Supremo diante do Habeas Corpus impetrado pelo ex-presidente Lula.
