Résumé On assiste en France à l’émergence de pratiques de négociation dans la fonction publique. Cet article se propose d’en étudier les caractéristiques en s’intéressant à la construction de compromis belliqueux dans la fonction publique territoriale. La recherche montre, à partir de la chronique d’une négociation sur le régime indemnitaire dans une mairie, comment se perpétue la tradition non-contractuelle des relations professionnelles à la française.
Cet article s’interroge sur les ressources et les capacités d’action syndicale pour améliorer les conditions d’emploi et de travail dans l’aide à domicile. En dépit des limites de la négociation collective de branche et d’entreprise dans ce secteur, il montre en quoi et à quelles conditions la branche professionnelle peut constituer une ressource pour les militantes syndicales de terrain. Pour ce faire, il propose une étude des actions et des formes de mobilisation menées par des représentantes syndicales, soit au sein des associations, soit auprès des pouvoirs publics, pour défendre les conditions d’emplois et de travail dans ce secteur peu propice à l’action syndicale.
