O presente estudo analisa aspectos da Lei 12.990/2014, que reserva para negros e pardos vinte por cento das vagas oferecidas em concursos p�blicos da Administra��o P�blica Federal direita e indireta. Para se chegar a algumas conclus�es, necess�rio abordar o tema das a��es afirmativas, com algumas defini��es e apresenta��o de suas origens, al�m de exemplos de medidas dessa natureza que est�o sendo adotadas oficialmente nos �ltimos tempos, para compensar o passivo hist�rico que o Brasil possui em rela��o � popula��o negra. Mas deve-se ter em mente que para aprova��o em concursos p�blicos, � necess�ria obten��o de notas m�nimas nas provas de conhecimento. Da�, a plena efetividade dessa regra depende tamb�m da qualidade da educa��o que a popula��o recebe. Essa an�lise, ainda, n�o pode ser separada da quest�o da situa��o social e econ�mica das pessoas a quem essa lei diz beneficiar, condi��es essas que podem impedir que elas cumpram os demais requisitos exigidos em provas de conhecimento. Afinal, as car�ncias econ�micas e educacionais dos brasileiros ainda s�o latentes. Outro fator prejudicial s�o as distor��es de natureza regional, diante da distribui��o n�o homog�nea da popula��o negra entre os Estados das cinco regi�es brasileiras. Necess�rio tamb�m se apresentar uma an�lise sobre a quest�o da igualdade racial, nos termos tratados em nossa Constitui��o. Todas essas reflex�es podem nos auxiliar a avaliar se h� possibilidade do pleno alcance dos fins almejados pela referida norma legal ou se esta lei se apresenta mais, como uma medida demag�gica com pouco efeito pr�tico na vida das pessoas a quem visa beneficiar.
