Número 124Enero - Abril 2009ISSN 0041 8633 LA CITTADINANZA NELLA SOCIETÀ DEL DIRITTO PRIVATO* CITIZENSHIP IN THE PRIVATE LAW SOCIETY Alessandro SOMMA** El sistema de los derechos fundamentales, en la forma en la cual fue diseñado por las Constituciones europeas con posterioridad al colapso de las dictaduras fascistas, ubica en el centro al principio de solidaridad: para alcanzar la igualdad sustancial entre los ciudadanos, el Estado debe asistir directamente a los necesitados y combatir, además, la debilidad social inherente a las relaciones de mercado. Este sistema ha sido puesto en entredicho por el derecho comunitario europeo que recupera los principios del liberalismo económico y concibe una adecuación del mercado sólo si es necesaria para evitar sus fallas. Para regresar a una cultura y a una práctica de la solidaridad, es necesario revitalizar el debate democrático y afirmar la supremacía de la política sobre la economía.
