The article examines the peculiarities of the formation in China the «supremance of law» as the management of society through strict observance of laws, which does not imply the subjective discretion of law enforcement officials. The development of Chinese legislation based on the legal theory of management methods, including in law enforcement, under the influence of moral rules adopted in society, which implies understanding and approval of the population when applying them, is studied separately. Currently, in China, there is a kind of harmonious combination of law and morality («rule of law» and «governance on the basis of morality»), and the legislation itself absorbs the moral rules adopted in society and develops under their influence. The approach that took place in the USSR, based on the wide involvement of the public in governing the state, administering justice, ensuring law and order, the execution of criminal penalties and other measures of influence against offenders, as a whole justified itself, including through the use of measures of social influence based on the rules morality. The Chinese experience testifies to the possibility in Russia comprehensively achieving the goals of applying criminal penalties in the form of restoring social justice, correcting convicts and preventing the commission of new crimes provided for in Art. 43 of the Criminal Code of the Russian Federation.
Цель. В статье проводится сравнительно-правовой анализ ряда норм северокорейского и российского уголовного законодательства. Рассматриваются виды наказаний и их содержание по Уголовному кодексу Корейской Народно-Демократической Республики. Дополнительно обращается внимание на систему наказаний, содержание всех наказаний (особенно пожизненные исправительно-трудовые работы, исправительно-трудовые работы на определенный срок и исправительновоспитательные работы), а также виды досрочного освобождения от их отбывания (специальное помилование, амнистия, досрочное освобождение от отбывания наказаний в случае перевоспитания осужденного). Методология: индукция, дедукция, анализ, синтез, сравнительно-правовой и формально-логический методы. Выводы. Формулируется авторская редакция ст. 27 Уголовного кодекса Корейской Народно-Демократической Республики «Виды наказаний». Представляется, что необходимо дальнейшее исследование Уголовного кодекса Корейской Народно-Демократической Республики и его сравнительный анализ с российским законодательством. Научная и практическая значимость. В статье выявлены особенности видов наказаний и их содержания по Уголовному кодексу Корейской Народно-Демократической Республики, что представляет интерес для сотрудников научно-исследовательских организаций и юридических факультетов образовательных учреждений. Ключевые слова: Уголовный кодекс Корейской Народно-Демократической Республики, виды наказаний, система наказаний, досрочное освобождение от наказания.
В статье актуализируется проблема ресоциализации и предупреждения рецидивной преступности лиц, отбывших наказание в виде лишения свободы, в том числе ранее условно-досрочно освободившихся. Выявляется проблема отсутствия четких критериев применения условно-досрочного освобождения и его привязки к достижению целей уголовно-исполнительного законодательства. Раскрывается исторический опыт исполнения ряда наказаний, регулирования и применения условно-досрочного освобождения на примере Забайкальской области в конце XIX-начале XX века. Делается вывод, что исторический опыт применения условно-досрочного освобождения свидетельствует о том, что само по себе освобождение лица не гарантирует ни исправления осужденного, ни предупреждения совершения новых преступлений, ввиду чего очевидна необходимость не только четкого определения критериев досрочного освобождения осужденных, но и постпенитенциарного контроля за их поведением. Ключевые слова: условно-досрочное освобождение, предупреждение преступлений, ресоциализация лиц, отбывших наказание в виде лишения свободы.
The article provides a comparative legal analysis of a number of norms of Qatari Criminal legislation, as well as Russian Criminal and Penal legislation. The types of punishments not related to isolation from society and their content under the Criminal Code of Qatar are considered in the article. In addition, attention is drawn to the system and content of individual punishments (in the form of fines and public works). The author’s version of Article 63 of the Criminal Code of Qatar is formulated; it concerns the main types of punishments and their content. Based on the conducted research, the authors conclude that the main types of punishments not connected to isolation from society and their content have significant specifics under the Criminal Code of Qatar, and in some cases relate to issues of punishments execution (which in Russia are regulated in the Penal legislation). This determines the need for further research of the Criminal Code of Qatar and its comparative analysis with Russian legislation.
