Objetiva-se, com este trabalho, analisar a aproximação entre o Direito Internacional Humanitário e o Direito Internacional dos Refugiados por meio da investigação documental e bibliográfica, utilizando-se o método dedutivo e a abordagem qualitativa. Será possível caracterizar as principais nuances de ambos os direitos e identificar, assim, as diretrizes onde ocorrem as convergências da função protetiva do Direito Internacional Humanitário e do Direito Internacional dos Refugiados. Abordaremos tal aproximação por meio do estudo das normas e dos princípios fundadores de ambos os direitos através de três caminhos: a análise histórica, a análise teórica e a análise prática, utilizando, para tanto, o referencial teórico dos autores Antonio Augusto Cançado Trindade, Christophe Swinarsky e a doutrina amplamente divulgada pelo Comitê Internacional da Cruz Vermelha e pelo Alto Comissariado das Nações Unidas para Refugiados. Por fim faremos um breve estudo de caso da atuação da Federação Internacional da Cruz Vermelha na Venezuela.
This article aims to revisit the interrelationship between International Humanitarian Law (IHL) and International Human Rights Law (IHRL), in honour of their respective normative scopes and in order to carry out an analysis of their complementary or supplementary application, towards the construction of a more appropriate tool for the protection of human beings in extreme situations, as it occurs during armed conflicts. This is because, amid the multifaceted vulnerabilities that accumulate in today's conflicts, it is essential to provide the most effective source of protection - proportional to the demands for protection that are manifested today, particularly in military occupations around the world, whose occurrence will be the focus of this research. As for the method of approach concerning the logical basis of the investigation, the hypothetical-deductive method was selected, insofar as the corroboration or falsification of the main hypothesis about the effective complementary and harmonious application of IHRL will be tested to cases of human rights violations in International Armed Conflicts in the military occupation modality. Given this framework, the core of this work lies in the understanding of the praxis for the complementary application of both aspects in armed conflicts, considering not only International Human Rights Law as lex generalis, but their effective overlap to the detriment of International Humanitarian Law, when it is most beneficial to human protection in the cases of Military Occupations.
O ato de se recorrer à violência generalizada como possível solução à resolução de conflitos demonstra o ato mais primitivo concernente à natureza humana. Quando o desejo de destruição e morte distorce os demais sentidos, os vulneráveis, os incapacitados e os não combatentes necessitam de resguardo, não por etnia ou bandeira, mas sim pelo simples fato de serem humanos. O Direito Internacional Humanitário (DIH) fundamentado na diminuição do sofrimento humano em conflitos armados, apresenta como objeto de proteção os seres humanos sem distinção, conforme fundamentação principiológica própria. Nessa perspectiva, o presente estudo busca destrinchar os princípios de DIH, com o objetivo de elucidar e aprofundar uma temática tão pertinente à realidade prática da geopolítica mundial, como se pode observar pelo contexto Afegão atual. Sob esse prisma, será analisado se os princípios entabulados em convenções e aceitos como práticas costumeiras internacionais foram respeitados pela maior potência global dentro de seus vinte anos de ocupação militar no Afeganistão, com foco ao caso do hospital de Kunduz.
