RESUMOA crise ambiental que se abateu sobre o mundo, nas últimas décadas, levou a humanidade pensar no desenvolvimento de novas formas e teorias filosóficas de preservação e ética ambiental. Partindo dessas informações, o presente estudo objetiva analisar a possibilidade de aplicação dos Direitos Fundamentais aos animais não humanos, como forma de ampliar garantias e direitos, decorrentes das mais diversas ramificações jurídicas, presentes em nosso ordenamento. Assim, utilizou-se como pressuposto metodológico a pesquisa descritiva, exploratória, pelo método bibliográfico. Foi realizado uma revisão sistemática de literatura em bancos de dados científicos com os descritores, direitos dos animais "não humanos", biocentrismo, antropocentrismo e ética ambiental no período de 2008 á 2013. Identificando estudos que aponta a visão biocentrica como uma nova corrente filosófica que tem ganhado espaço no ordenamento jurídico envolvendo os animais "não humanos" em políticas ambientais de preservação. Conclui-se que a visão antropocêntrica está cedendo lugar à visão biocentrica, onde o homem não é mais o centro de tudo. Neste contexto entende-se que os animais "não humanos" são passíveis de direitos a vida, a não maus tratos. Palavras
