The article focuses on comparative analysis of argumentative frames' distribution in the text of appeal court decisions pertaining to different law systems: US court opinions and Russian appellate rulings. Text of court decision is a communicative product of the judicial discourse which is argumentative by virtue of its nature; however, the sequence of frames implementing the argumentative discourse dynamics is specific to each type of court decision generated within respective law system. The present article explores the applicability of frame analysis to judicial argumentation in appeal court decisions pertaining to different law systems. The current interest of the research lays in the fact that court decision texts represent a relatively regular sequence of cognitive argumentation frames that provide for argumentative discourse dynamics, and that can be viewed as a cognitive tool of developing judge's argumentation strategy. The article aims at conducting an experiment on distribution analysis of the identified argumentation frames in the specified category of court decision texts and compare the traced regularities. The research methodology rests on application of the following methods: distribution analysis method, method of statistical analysis, methods of functional and structural analysis. The materials for the research included 50 texts including court opinions made by United States Court of Appeal for the seventh and ninth circuits and appellate rulings of Altay Regional Court (appeal instance). All documents carried the same type of the decision -affirming the lower court decision -and referred to criminal law only to preclude possible dependence of the research results on type of decision and branch of law concerned. In the research findings we came to the conclusion that within the chosen category of cases argumentation frames' distribution patterns exhibited insignificant variability however they were not absolutely rigid. The research outcomes can find further application for argumentation structure analysis in other categories of court decisions or other genres of the judicial discourse.

A mineração pode resultar em impactos adversos para os ecossistemas naturais e saúde humana. Tendo em conta os graves rompimentos que ocorreram recentemente no Brasil (nos municípios de Mariana e de Brumadinho, no estado de Minas Gerais) e a relação existente entre saúde e meio ambiente, o presente trabalho buscou levantar, por meio de uma revisão bibliográfica, os impactos desencadeados pelo rejeito de mineração sobre a saúde humana e ecossistemas naturais. Os impactos ambientais implicaram diretamente na alteração do metabolismo e funcionamento dos ecossistemas naturais, devido à contaminação dos compartimentos ambientais e dos prejuízos à biodiversidade. Quanto à saúde humana, foram evidentes os riscos de intoxicação, prejuízos à saúde mental, agravos de doenças existentes, arboviroses e zoonoses. Os resultados deste estudo podem contribuir para o estabelecimento de estratégias e formulação de políticas públicas que visem a reversão do cenário encontrado.

Mining dam failures have increased worldwide since the 1980s. Two large mining dam failures occurred recently in Mariana and Brumadinho, both in the state of Minas Gerais, Brazil. We hypothesize that there were significant differences in legal post-disaster decisions. The aim of this article is to understand the similarities and differences of post-disaster actions and controversies in Mariana and Brumadinho. We reviewed 686 news reports about court decisions and settlement agreements from the websites of state and federal courts and judicial institutions. After classifying the reports using an adapted protocol from a media health observatory, we conducted a thematic analysis. Our analysis suggests that there were significant differences in legal post-disaster decisions in the cases of Mariana and Brumadinho. In Mariana, there was privatization of post-disaster management, with the creation of the Renova Foundation, a mediated indemnity program, lack of access to information for those affected, and uncertainties in health and resettlement issues. In Brumadinho, there was faster implementation of the recovery and compensation measures, faster recognition of affected parties, and stronger participation of the population since the first hearings. Even though there were particularities in post-disaster management, the ultimate goal of the corporations responsible for the disasters was to protect their profits.
