<p>El trabajo toma el caso mexicano de la exigencia legal de comités de bioética: comités hospitalarios de bioética (CHB; comités de ética asistencial, o comités de ética clínica), y los comités de ética en investigación (CEI). La Ley General de Salud hace obligatorios esos comités desde una modificación en 2011. La literatura refiere que los comités de bioética cuentan con tres funciones básicas: educativa, consultiva y normativa. El marco legal vigente retoma elementos teóricos importantes. Uno de ellos corresponde a las funciones de los comités de bioética. Se profundiza en el análisis de la función educativa, toda vez que una buena parte de la literatura disponible se dirige a la función consultiva. Así mismo, se realizan algunas propuestas sobre algunos contenidos en materia educativa. Pueden organizarse grupos de problemas éticos alrededor del inicio de la vida humana, y problemas éticos alrededor del final de la vida humana. Efectivamente, hay muchos problemas éticos toda la vida, pero entrar o salir de la vida parece ser más conflictivo desde el punto de vista ético.</p>

“…As such, and reiterating a point already noted, even those with whom ethics consultants work closely over time may not fully know what to expect regarding the role of ethics consultation or of the actual work of ethics consultants. What follows are thus illustrations of six common expectations those with whom we interact often bring to ethics consultations, or articulate when they encounter us qua “ethics consultant.” These expectations reflect both what we have gathered from our own clinical encounters and experiences and what may be found within the clinical ethics literature; indeed, some version or another of the expectations we experience daily are noted in the literature from the earliest days of the field (Annas, 1984 ; Churchill, 1978 ; Churchill & Cross, 1986 ; Fleetwood et al, 1989 ; La Puma & Toulmin, 1989 ; Siegler & Singer, 1988 ; Skeel & Self, 1989 ; Spicker & Sushner, 1989 ; Zaner, 1984 ).…”

Clinical ethics consultants (CECs) work in complex environments ripe with multiple types of expectations. Significantly, some are due to the perspectives of professional colleagues and the patients and families with whom CECs consult and concern how CECs can, do, or should function, thus adding to the moral complexity faced by CECs in those particular circumstances. We outline six such common expectations: Ethics Police, Ethics Equalizer, Ethics Superhero, Ethics Expediter, Ethics Healer or Ameliorator, and, finally, Ethics Expert. Framed by examples of requests for ethics consultation that illustrate each kind, along with brief descriptions, we argue that while these expectations ought to be resisted for clear and practical reasons, they also create opportunities for CECs to articulate, educate, and ultimately be responsible to the professional demands of clinical ethics work. Recognizing, acknowledging, and at times resisting those expectations thus become key activities and responsibilities in the performance of ethics consultation.

We believe that clinical ethics consultation (CEC) has as its goal the delivery of healthcare in a manner consistent with the moral rules and the moral ideals. Towards this end, CEC pursues the instrumental ends of clarifying the limits of acceptable ethical disagreement and facilitating a choice among ethically acceptable alternatives. In pursuing these ends, healthcare ethics consultation (HEC) and CEC services confront three broad categories of questions: (1) questions of professional duty; (2) questions of law; and (3) questions of general morality. Professional duty questions concern what has been referred to as the "internal morality of medicine", and include questions such as the medical legitimacy of the goal(s) being pursued, or the acceptability of the means being employed. Questions of law concern themselves with what the law requires, permits or prohibits. Questions of general morality include all those not falling within the scope of the above categories. We submit that this has implications for the organization and structure of consultation services and HEC and for the methodology and processes employed in CEC. Thus: (1) questions of professional duty should be addressed only by physician members (whom we would distinguish by employing the term "ethicians") of the HEC or CEC service. The only role for non-ethicians under these circumstances would be in helping to resolve disagreements between/among professionals; (2) questions of law, in contrast, should be addressed only by the attorney member(s) of the HEC or CEC service; (3) questions of general morality may be addressed by the entire membership of the HEC or CEC service.
